大学生创新训练项目 研究报告 项目名称： 基于劳动关系视角的大学生兼职及其权益受损情况调查——以北京市某高校为例 项目类型： 一般项目 项目年度： 2014年 项目负责人： 付红雪（学号：32012050170） 负责人院（系）： 劳动经济学院 专业（方向）： 劳动关系 项目组成员： 周文、李京、李昊男、白子薇 指导教师： 冯喜良 教务处 制 二〇一五年 摘要 大学生是社会重要的人力资源，近些年来逐渐增大的就业压力让越来越多的大学生选择通过兼职增强社会实践能力，赚取额外生活费用，拓展社交范围。与此同时，兼职大学生的权益受损情况也屡见不鲜，这是一个不可忽视的社会问题。然而鉴于大学生身份较为特殊，法律并没有规定大学生兼职要签订劳动合同，因此当大学生权益受到侵害还没有比较有效的解决办法。本文旨在用劳动关系的专业视角，以北京市某高校为例，通过问卷调查和个案访谈的方法对大学生兼职及其权益受损情况进行调查。在总结访谈内容、统计分析数据、借鉴相关研究成果的基础上了解到大学生兼职兼职信息的来源，兼职的行业和目的，遭受侵权的类型、原因及应对措施等问题。最终我们发现对兼职大学生的劳动关系认定是保证其权益的基础，兼职大学生的权益保护需要个人、学校、法律和社会的共同努力。因此，我们希望通过此次调研呼吁社会各界关注重视兼职大学生的权益受损问题，并为相关研究提供借鉴。 关键词：劳动关系、大学生兼职、权益受损 Abstract College students are important human resources community, the employment pressure in recent years gradually increased so that more and more students are choosing part-time social practice enhanced ability to earn additional living expenses, expand social range.
