一 分批装运案例解读 我国某公司向国外出口大豆1 000公吨，国外来证规定：“不允许分批装运。装运期不晚于10月30日”。卖方分别于10月15日、10月17日在大连、青岛各装500公吨大豆于同一航次的同一船只上，提单上注明了不同的装货港、不同的装船日期及相同的目的港。 问卖方是否违反了信用证的规定？ 一 分批装运案例解读 分析：卖方没有违反信用证的规定。 因为《UCP600》规定，同一船只、同一航次中多次装运的货物，即使提单表示不同的装船日期及不同的装货港口，也不作为分批装运。在本案中，虽然卖方分别在大连、青岛各装500公吨大豆，并且提单上注明了不同的装货港、不同的装船日期，但是货物是装在同一航次的同一船只上，因此不属于分批装运。 二 《UCP600》关于分批装运的规定 Article 31 Partial Drawings or Shipments? a. Partial drawings or shipments are allowed. b. A presentation consisting of more than one set of transport documents evidencing shipment commencing on the same means of conveyance and for the same journey, provided they indicate the same destination, will not be regarded as covering a partial shipment, even if they indicate different dates of shipment or different ports of loading, places of taking in charge or dispatch.
