THE AMENDMENT OF LAW FOR FOREIGNERS LIVING WITH HIV IN TAIWAN Taiwan Love and Hope Association Vice Director Rose Wu TWO REAL STORIES HAPPENED IN TAIWAN In the early 1990s, jade, who came from south-east Asia, married with A-Guo, a Taiwanese. jade was tested HIV positive when she was pregnant, and A-Guo was tested HIV positive later. The information of infection was a big shock for them. jade was told, by health bureau, to leave Taiwan one month after giving birth. The couples could not even imagine if there is a family-reunion day in the future. Before jade leaved Taiwan, no one told them that they actually have the right of striving for staying in Taiwan. Many years after Spring(an indonesian) married with her Taiwanese husband, she was tested HIV positive when applying for a R.O.C. ID. Her HIV-negative husband did not mind her infection, but Spring was required to leave Taiwan by the law. They were helpless. All what they could do is crying secretly until the day they separated. From 1984 to 2011, 754 foreigners were recorded HIV infected in Taiwan. But we do not know how many of them were forced by the law to leave their family and lives in Taiwan. Through these cases we have reached, we can see the human rights of HIV-infected foreigners and migrants are disregarded and abandoned . These HIV-infectied foreigners and migrants are our friends, lovers, or family. They are part of us and they are not criminals. However, they are severely punished. ★In December of 2010, TAMLHA was composed by the migrant NGOs and the HIV/AIDS NGOs. We hope more people to know that there is no need to differentiate nationality, race, and ethnicity, in HIV prevention work. Only if human rights are protected for everyone, we can reach the achievement of HIV prevention. ★The main goal of TAMLHA is to improve the existing but unreasonable law that violate the human rights of HIV-infected foreigners and migrants. “Infected by Taiwanese spouse” which mentioned in §16 should
