中国盗版影碟泛滥现象及其法律规制 摘 要：中国音像制品市场上盗版泛滥现象已经是不容回避的重大问题，盗版对知识产权的保护，对文化市场的建立健全，都构成了极大的阻碍。影碟盗版现象屡禁不止的原因主要包括两个方面：即消费者的巨大需求支撑着盗版市场的存在和发展，而电影制度的不完善以及立法和司法的缺陷是这个背后的深层次原因。为了达到最大程度的保护版权人的利益的同时构建能够充分传播文化的法律机制这一最终目的，维持个人利益和社会公益的平衡， 关键词： 盗版影碟 知识产权的立法目的 利益平衡 1 Film piracy and its legal regulations in China Abstract：Copyright pirate has already been the major issue which wasn’t allowed to avoid in the Chinese audio and video product market. It was almost the most enormous hindrance to the intellectual property rights protection and the cultural market establishment. Why the video-disc pirate phenomenon still severe after forbidden? The reason mainly includes two aspects: firstly, the huge demand of consumer props up the market of video-disc pirate .secondly, the limitation of movie system, the blemish of legislation and judicatory are the most important reasons. For forming a legal mechanism which could fully disseminate the culture and protecting person’s benefit of copyright in the greatest degree, keeping the balance of personal interest and the social public welfare, this article try to give some suggestions: Perfecting the movie system, sounding the system of intellectual property rights, improving the way of enforcement of law and strengthening citizens’ consciousness of law. Finally, I will prove the rationality of those suggestions using the legislative purpose of intellectual property rights.
