论完善我国保障性住房立法 内容提要 我国飞速涨房价引起社会各界热议。本文主要采取文献调查法来研究我国保障性住房立法的问题，保障性住房法律制度的构建和完善是我们面临的一项重要任务。改革开放以来,我国政府采取了一系列的住房保障政策,也在保障性住房问题上进行了积极的探索,设置了经济适用房制度,廉租房制度,公租房制度,住房公积金制度,等等,但是随着经济社会的发展,我国保障性住房制度的弊端也日益凸显,如保障主体不明确,保障监督不到位,保障制度程序的漏洞滋生出来众多腐败等,这些问题的出现都引导着我们对保障性住房制度重新的思考。保障性住房建设是我国政府为平抑房地产价格,保障中低收入者有房可住的重要政策。我们要知道,保障性住房法律制度是社会保障制度的重要组成部分,是政府通过立法对保障性住房规划、建设、分配和管理等各个环节进行规范和制约,从而保障中低收入家庭特别是住房困难家庭的基本居住权的一种国民居住保障法律制度。国内外经验都表明, 住房关系民生, 特别是低收入家庭住房问题不仅是经济问题, 也是社会问题和政治问题, 不能完全通过市场化来解决, 政府要承担责任。解决城市低收入家庭住房困难问题是房地产市场调控重要内容, 也是建设和谐社会的重要内容, 是深受广大老百姓拥护的惠民工程, 政府责无旁贷。本文先介绍我国目前保障性住房法律制度的现状,然后分析其存在问题，在发达国家和地区保障性住房政策经验借鉴的基础上, 提出我国构建多层次住房保障体系的模式选择和基本框架。 关键词：保障性住房、立法、制度、完善 Abstract Chinas rapid rise in prices caused by all circles of the society of hot debate. To study our affordable housing legislation this paper mainly adopts the literature investigation method, the construction of affordable housing and perfect the legal system is an important task that we face. Since the reform and open policy, our government has adopted a series of policies of housing security, also has carried on the positive exploration in the protection of housing problem, set up the economic application of the housing system, low rent housing system, public housing system, housing provident fund system, and so on, but with the development of economy and society, the drawbacks of the indemnificatory housing system I the country has become increasingly prominent, if not clear the main security, security supervision is not in place, security system program bugs breeding out many corruption, these problems have led us to think again about the indemnificatory housing system. The protection of housing construction is our country government to stabilize property prices, protect low-income people have important policy room to live. We want to know, the protection of housing legal system is an important part of social security system, is the government passed legislation to standardize and restrict the links of the indemnificator
