施工过程中主材价格波动引起的合同价款 调整问题研究 摘 要 在实际建设项目中，材料费约占工程造价费用的60%到65%，同时主要材料费用在材料费中占有较大比重，因此在施工过程中主材价格的波动将直接影响整个项目的工程造价费用。然而主材价格会随着经济发展等因素发生波动，在此情况下，本文将对承发包双方如何处理施工过程中主材价格波动引起的合同价款调整问题进行研究。 基于上述现状，本文在对现有文献资料、价款调整相关规定研究的基础上，提出解决施工过程中主材价格波动引起合同价款调整的四个关键问题。首先应明确主材的范围，从法律法规以及文献的角度出发，对关于主材范围的资料进行初步研究，并通过实际工程案例分析主要材料费比重，从而确定主材的范围。其次，应确定主材价格波动的调整幅度范围，通过文献和法律法规了解目前调整幅度范围的研究程度，运用时间序列平滑法、模糊综合评价模型等经济学模型拟找到一种确定调整幅度范围的方法。再者，应确定主材价格波动引起的合同价款调整的方法，结合案例对目前建设项目中常用的三种价款调整方法进行阐述，并结合合同类型特点，指出在不同合同类型下适合的价款调整方法。最后，应确定主材的调整数量，本文拟从消耗量和进场量的角度对主材的调整数量进行确定，并指出如何借助计算机软件快速实现消耗量的统计，同时结合实际案例指出进场量的确定方法。 本文围绕四个关键问题，提出每种问题的解决思路或方法，为此后解决此类问题提供依据。同时为承发包双方在处理施工过程中主材价格波动引起的合同价款调整问题时，提供了理论与实际建议 Research on Contract Payment Adjustment caused by Price Fluctuations of Main Material in the Construction Process ABSTRACT In the actual construction project, the cost of materials accounts for about 60% to 65% of the engineering cost. At the same time the cost of main materials accounts for a large proportion of the material costs, therefore the price fluctuations of the main materials in the construction process will directly affect the entire project cost. While the price of the main materials will fluctuate in accordance with the factors such as the economic development, how both parties of the contract deal with the priceadjustment of the contract caused by the price fluctuations under such circumstances will be discussed in this study.
