内容摘要随着市场经济的发展、经济体制的改革，城镇化步伐不断加快，市场主体呈现生产经营多元化、劳动用工灵活化特点，农村人口不断向城镇转移，非农产业逐步向城镇聚集，农业劳动力大规模向非农业劳动力转变，农民工群体日益庞大。他们生活重点转移到城市，基于自身文化程度、劳动技能等条件，大多数从事着艰苦而危险的体力劳动，在工作中面临着较之其他群体更高的意外事故和职业伤害威胁。但现行的工伤保险制度存在诸多不足，亟需完善。笔者以问题为导向，从政府职责的角度，分析了农民工工伤保险制度存在的问题和原因所在，并提出强化政府职责完善农民工工伤保险制度的建议措施，以期对农民工群体权益的保护提供有益参考。正文第一、二部分介绍了研究背景、意义、综述以及与工伤保险相关的基础概念和理论；第三部分从我国工伤保险的发展历程阐述当前农民工工伤保险的实施情况，介绍国外发展较为成熟的工工伤保险制度以期从中获得启示并学习其先进做法；第四部分通过总结我国农民工工伤保险存在的主要问题，即工伤参保范围受限、劳动合同签订率低、工伤争议解决程序复杂、工伤案件调查取证难、工伤预防和康复机制不健全等；第五部分阐述了政府在农民工工伤保险的实施中存在的职责缺位问题，包括制度层面、执法监管层面、劳资关系构建层面以及公共服务层面存在的问题；第六部分以发达国家和地区的工伤保险制度为参照，提出我国政府在农民工工伤保险制度的健全完善中应有所作为，即增强农民工工伤保险政策的科学性、提高农民工工伤保险执行力、推进农民工工伤预防与康复机制建设、完善农民工工伤保险配套保障措施，最终建立起融“预防－补偿－康复”于一体的工伤保险运行机制。关键词：政府职责农民工工伤保险AbstractAlongwiththedevelopmentofmarketeconomyandthereformofeconomicalsystem,theurbanizationisaccelerating,themarketparticipantshavepresentssuchcharacteristicsasdiversifiedproductionandflexiblelabor.Theruralpeoplehavebeinglargelymigratedtothecitiesandtowns,andthenon-agriculturalindustrieshavebeinggatheredtocitiesandtownsgradually,large-scaleagriculturallaborforceturnedintonon-agriculturalone,thusthemigrantworkersincreasinglybecomealargegroup.Whiletheirlife’sfocusshiftstothecity,basedontheirculturaldegree,laborskillsandotherconditions,mostofthemengageindifficultanddangerousphysicallabor,facinggreateraccidentandoccupationalinjurythreatsthanotherpeople.However,thecurrentindustrialinjuryinsurancesystemhasmanydeficienciesandneedtoimprove.Orientedfromtheproblems,theauthoranalyzesthedutyfailureofthemigrantworkers’industrialinjuryinsurancesystemandputsforwardsomesuggestionsandmeasuresforstrengtheningthegovernmentresponsibilityandperfecttheworkinjuryinsurancesystemformigrantworkers,inthehopeofprovidingausefulreferenceforgroupsofmigrantworkersrightsprotection.Thefirsttwopartsintroducetheresearchbackground,significance,reviewandtherelatedbasicconceptsandtheoryoftheindustrialinjuryinsurance.Thethirdpart,fromtheangleofthedevelopingcourseofindustrialinjuryinsuranceinourcountry,setsforththecu
