ABSTRACTFraudulentraisinggenerallyreferstothebehaviorofmenraisingothers’childrenwithoutunderstandingthetruth.Currently,civilactionscausedbysuchbehaviorhavebeenfrequentlyoccurredinpractice,butfewrelevantregulationshavebeendevelopmentbytheexistinglawofChina.Injudgmentsofsuchcasesthatarewelldocumented,theauthorfindsoutthatvictimsofthefraudulentraisingoftenproposethreereliefrequeststothecourt,namely,divorce,alimonyreturnandcompensationformentaldamages.Althoughthejudicialworkisdifficulttobeconductedbecausethereisnolegalbasis,judgesmostlysupporttheclaimofvictimsappropriatelyonthebasisofclearfactsandpositiveevidence.Byclarifyingwhatthelegalnatureoffraudulentraisingisandhowtheissueshouldbehandledastheoriginalintention,thispaperisexpectedtopromotethelegislationimprovementaboutfraudulentraisinginthefuture.Inadditiontotheepilogue,thispaperisdividedinto5parts.Partoneisabouttheproposaloftheproblem.Throughtheanalysisaboutthejudgmentbasisandjudgmentresultsinsomepracticalauctions,thispaperputsforwardembarrassingjudicialproblemsincludingthedisorderedlegalbasisandreasonablebutillegaljudgmentresultsinfraudulentraisinglitigation,anditisreckonedthattheproblemismainlycausedbythelackofrelevantsupportinglawsinChina.Theconceptandfeaturesoffraudulentraisingarediscussedinthesecondpart.Thepaperfirstsummarizesthreedefinitionstofraudulentraisingbythescholarcircle,andthengivesitsowndefinitiontosuchbehavior.Itisconsideredthatsubjectsofthefraudulentraisingrelationshipshouldberestrictedtobiologicalfathers,biologicalmothersandfosterfathersbutthetimefactorcanbeexpandedtothecohabitationperiod,marriagedurationperiodandtheperiodafterdivorce.Atlast,featuresaboutfraudulentraisingaresummarizedbythepaper.Partthreegivesananalysisaboutthelegalnatureoffraudulentraising.First,itbrieflyintroducesandelaboratesfivetheoriesinthescholarcircleatpresent,thatis,unjustenrichment,negotiorumgestio,noncompliance,ineffectiveactsandinfringementacts.TheauthorconfirmstosupporttheviewofProfessorYangLixin,thinkingthatfraudulentra
