Inc” 一案（以下简称 eBay 案）是近年来关于网络商标侵权的经典案例之一。本文以此案为研究 对象分为四章进行研究：第一章是网络交易平台服务商商标侵权案例的实证分析。本章简要分析了 eBay 案 的基本案情、判例及案件反映的相关问题：对 eBay 的角色定位的理解；eBay 的行为是 否构成商标侵权；主观过错认定标准的判定；明确网络商标侵权监管义务的承担。第二章是讨论网络交易平台服务商的角色定位。目前理论界对于网络交易平台服务 商的角色定位主要存在着“卖方或合营方”、“居间人”、“场地出租人”三种观点。本章 以 eBay 案为例分析网络交易平台服务商的概念及运营模式，并对 eBay 购物网站类似场 地出租人的角色定位进行了评析。第三章是网络交易平台服务商商标侵权的认定。对于直接侵权讨论了美国《兰哈姆 法》并对其认定标准进行了理论分析。间接商标侵权论述了其概念及认定标准，并着重 分析了间接商标侵权的构成要件。第四章是网络交易平台服务商商标侵权的法律规制。本章首先论述了我国关于商标 侵权的相关立法规定及存在问题，在此基础上介绍了美国与欧盟相关立法规定及各自的 特点并对我国相关立法提出了完善建言。关键词：网络交易平台服务商；eBay；协助侵权；认定标准；侵权构成要件In recent years, online shopping has become a new shopping way which is very popular with young people. In this context, many shopping sites arises have emerged.
