AbstractTheInheritanceLawofthePeoplesRepublicofChina(hereinafterreferredtoasinheritancelaw)begantoimplementin1985.Thelawstrippedtherelevantprovisionsaboutinheritanceintheoriginalmarriagelawandsystematicallystipulatetheinheritancerelationshipofourcountry.Theinheritancerightsandobligationsbetweenstepparentsandchildrenhasalsoevolvedfromasinglestipulationtoamoreelaboratespecification,butunfortunatelyonlyprovisionsincreasedandtherewaslittlechangeinthesubstance.Thenatureofthespecificationremainsapplyingtheinheritancestipulationbetweenparentsandchildrentothatbetweenstepparentsandtheirchildren.Agoodlawshouldbeabletobalancetheinterestsofallthepartiesconcernedandtheinheritancelawisnoexception.Onlybalancetheinterestsofallpartiesincludingtheheir,thedeceasedandotherswhoarerelatedtotheinheritancecanitadaptthedevelopmentofthesociety,maintainthesolidarityofthefamilyandsafeguardthestabilityofthesocialorder.Andasfortheinheritancerightsofthestepchildren,thefollowingpartiesmayinvolveintheinterestsincludingparents,birthparents,stepchildren,biologicalchildrenandeventheotherlegalheirsandhowtobalancetheinterestsofthem,maintaintheharmonyoffamiliesareallneededtobeaddressed,nodoubt,bytheinheritancelaw.Chinasexistinglawsstipulatethatthestepchildrenwhohaveformedthefosterrelationshipwiththeirstepfatherorstepmotherenjoythemutuallegalinheritancerightswiththeirstepparents.However,therehasbeentwodiametricallyopposedviewsfromtheperspectiveoftheory,namelyaffirmativetheoryandnegativetheory.Comparingthetwotheorieslaterally,Ibelievethatinaccordancewiththenatureofinheritancelawtheinheritancerightsofthestepchildrenshouldberetainedandbeimposedonrestractionstrictlytocomplywiththeprincipleofrightsandobligationsbeingcompatible.IfyouwanttostudyChina’sinheritancerightssystemofthestepchildren,youmustdosomeinvestigationabouttherelationshipbetweenthestepparentsandstepchildrenwhichdirectlydeterminesthepresenceorabsenceofastep-child’sinheritancerights.ThispaperwillstartfromthebasiccontentandhistoricalevolutionofChina
