摘要贸易救济的根本性质是为了有效地维护国际贸易中的公平贸易秩序，制止不正当竞 争行为，在一定范围内维护成员方国内产业安全。贸易救济措施主要包含反倾销、反补 贴和保障措施，是在国际贸易自由化的同时，各国用来保护自己的一个合法工具，它具 有名义上的合法性。加入世贸组织以来，我国经济越来越融入全球化，国内市场进一步扩大开放，产业 安全面临日趋复杂、不确定性因素增多的严峻挑战，在此情况下，政府在贸易救济中是 否准确定位、能否发挥积极有效的作用，将直接关系到能否为产业发展创造一个良好的 市场环境，从而维护好产业的安全。由于我国入世时间较晚，接触贸易救济实践时间很短，贸易救济相关法律法规尚不 完善，贸易救济仍然是新的工作领域，各级政府对于自身在贸易救济工作中的定位、应 履行的职能和应承担的职责尚不清晰。文章主要采用理论研究、比较研究、案例研究、 归纳总结相结合的方法，通过对比国内外在贸易救济中的实践，结合案例分析，对我国 政府在贸易救济工作中的定位和职能进行探讨，为进一步完善贸易救济工作体系建设提 出意见和建议。以期通过完善贸易救济工作体系，为产业发展创造一个良好的市场环境， 从而维护好产业的安全。关键词：贸易救济，反倾销，反补贴，保障措施，体系建设AbstractThe basic properties of the trade remedy is to maintain effectively equitable international trade order in international trade, stop unfair competition acts, maintain industrial safety of member countries within the scope of certain. Trade remedy measures mainly include anti-dumping, anti-subsidy and safeguard measures, that is a legal tool that each country to protect itself in liberalization of international trade, it has nominal legality.Since Chinas accession to the WTO, Chinas economic globalization, more and more into the domestic market further opening up and industrial security faces increasingly complicated, uncertainties multiply the severe challenge, in this case, the government in trade relief whether accurate position, can play a very active and effective role, will directly relates to whether for industrial development to create a good market environment, thus maintaining good industrial safety.Because the time for our country accessing to WTO being too late, the time for contacting trade remedy practice being short, the corresponding laws of the trade remedy remaining imperfect, the trade remedy still is new work field, the governments at all levels remains unclear to location of the trade remedy work, remains unclear to the functions to be performed and duties to be undertaken.
