摘 要自然资源和生态环境是社会经济发展的基础。就目前的能源形势来看，我国能源特 点是富煤、贫油、少气，这就决定了煤矿资源在我国能源生产和消费当中的主导地位。 随着我国工业化脚步的不断加快和人口数量的增长，煤矿资源的需求数量也在日益增 加，这不仅会导致煤矿资源的减少甚至枯竭，还会对煤区脆弱的生态环境带来严重的污 染和破坏。面对煤矿资源开发利用所带来的一系列环境问题，对煤矿资源开发生态补偿制度的 研究是一种行之有效的能够以低的资源消耗，在维持生态平衡前提下获取较快经济发展 的途径。建立并完善煤矿资源生态补偿制度，是一种能够很好的保证煤区生态修复高效 顺利进行的方式。对我国煤区生态环境进行保护、治理、恢复和管理是具有重要现实意 义的。/Economic/经济学上所说的生态补偿是从成本利益的视角揭示了法律制度当中的生态效益补 偿中的障碍本源与应该处理好的方面；法律则是以公正作为其第一要实现的价值目标， 表现在生态补偿制度中，凭借权利、义务的对等与和谐为逻辑出发点。对生态环境破坏 弥补赔偿的法律制度其逻辑构成主要因素应当包括补偿的主体本身、补偿的依据和补偿 的方法等。本文以经济法的视角对我国煤矿资源的现状，煤矿资源开发自然环境现状和 生态补偿现状进行分析，对国内外有关生态补偿制度的研究基础上，总结了生态补偿的 涵义、特点以及生态补偿的理论基础；对我国建立煤矿资源生态补偿机制的依据以及其 必要性和可行性进行了论述；分析我国现行的煤矿资源生态补偿制度及其实践，指出其 在法律、监督管理和生态补偿费用证收费方面还存在一些不足，有待进一步完善；最后 在对目前我国煤矿资源生态补偿制度的构建进行了思考，提出生态补偿法律制度建立的 基本原则和补偿内容，并提出几点措施。关键词：经济法学，煤矿资源，自然资源，生态环境，生态补偿制度AbstractNatural resources and the ecological environment is the foundation of social and economic development.
