内 容 摘 要近年来，信用卡以其便捷、安全的特性深受人们的欢迎，因而我国的信用 卡业务获得了迅猛的发展。但与信用卡业务蒸蒸日上的情形形成强烈反差的是， 广大持卡人的权利却得不到充分、有效的保护，发卡银行利用其优势地位在信 用卡使用的各个阶段、各个层面上不同程度地侵犯着持卡人的合法权益。一方 面，从法律的基本精神来看，保护消费者的合法权益，在双方地位不对等的情 形中倾向保护处于弱势地位的地方以实现实质正义，本就是法律制定和实施的 题中之义。另一方面，消费者（持卡人）作为市场经济的基础，其需求和权益 的保护支撑着整个市场经济的建立与运行，以牺牲消费者的合法利益为代价换 取短期的高额利润终究将导致市场信心的崩溃和交易的萎缩，最终将损害信用 卡业务的发展。因此，保护持卡人的合法权益势在必行，而如何保护持卡人的 合法权益，则是本文所欲探讨的核心问题。除引言和结语外，本文主要包括四个部分：第一部分概括介绍了信用卡合 同定义、性质等，分析了信用卡合同各方当事人之间法律关系。第二部分介绍 了信用卡从申请、签订合同到交易使用全流程中我国持卡人所应享有的权益并 提出持卡人权益保护所面临的问题。具体就是持卡人个人信息的保护，持卡人 的知情权，还有交易过程中未经授权使用的风险划分和抗辩权切断问题。第三 部分是分析美国等信用卡业务发达国家和地区信用卡法律。第四部分详细论述 了持卡人权益保护相对应的革新思路即应注重平衡分配发卡行与持卡人之间的 权利义务关系，充分保障持卡人合法权益。分别提出持卡人个人信息保护的完 善、信用卡合同应予规范化以尊重保护持卡人的知情权、在信用卡交易过程中 对交易风险进行合理的分配，持卡人抗辩权在一定条件下予以接续，避免持卡 人负担过重的交易风险，以保护其合法权益。关键词：持卡人权益;个人信息;知情权;未经授权划拨;抗辩权ABSTRACTIn recent years, credit card has been increasingly embraced due to its convenience and safety, therefore the credit card business in our country develops very dramatically. However, being different from the above situations, rights of credit card consumers are not protected effectively and sufficiently, the legitimate rights and interests of the cardholder are always infringed by the issuing bank which uses its dominance in the different stages of the credit card. On one hand, from the perspective of the basic spirit of the law, protecting the legitimate rights and interests of consumers and the disadvantaged in the unequal status of situations to realize the substantial justice is one of the basic connotations in the formulation and implementation law. On the other hand, consumers (card holders) are deemed as the foundation of the market economy, i.e. the protection of the rights and interests of the consumers will support the establishment and operation of the market economy. However, the sacrifice of the legitimate interests of the consumers for short-term profits will eventually lead to the collapse of confidence in the market, and even will damage the development of credit card business.
