AbstractInrecentyears,theincidentsaboutMisjudgedCriminalCaseshavebeenhittingthenewspapersfrequently.Forinstances,thecaseofZhaoZuohaiinHeNanProvinceandofZhangGaopinginHangZhou.Whilethemisjudgedcasescameuptothepublic,theyalsoraisesomequestionstothejudicialorgans:Whydoesthemisjudgedcasecomeuponeafteranother?Whatarethecauses?Howtopreventthemisjudgedcasesforthejudicialorgan?Whoshouldberesponsibleforthem?Andhow?Asamatteroffact,theMisjudgedCriminalCasesshowindifferentwayssincethecriminaljudicialactivitiesappearedwhereverinChinaorinwesterncountries.Itiscausedbytheparticularityofcriminaljudicialactivities,andalsotheirnature.Althoughthemisjudgedcasescouldn’tbeeliminated,wecanrestricttheminthemaximaldegreebyconsummatingthereliefsystem.Astheoriginsofcriminaljudicialactivities,investigativeagenciesareattheforefrontofthefightagainstcrime.Duringtheentirecriminalproceedings,thecriminalinvestigationactivitiesleadtothemisjudgedcasesandinvasionofhumanrightsforthemostpart.Impropriateinvestigationactivitiesconcealthemselvesbehindalmosteverymisjudgedcasewhichwasexposedtothepublicrecently.AfterZhangGaopingandhisnephewwerefoundnotguilty,allthepressbegantoaccusethepolicewomanNieHaifen,whohasbeeninchargeofthecase.Sometimes,theundertakersofthemisjudgedcasesevenchoosetokillthemselvesinordertogetridofthehugepressurefromthesociety.Thusitcanbeseenthatmisjudgedcriminalcasesaredrawingpublicattentionterrificallywhileputtingalotofpressureonthepoliceofficers.Therefore,it’sakeyproblemhowtopreventmisjudgedcasespreviouslyandtoholdaccountabletheundertakersafterwards.Observingfromtheangleofinvestigationactivity,thispaperaimstofindoutthereasons,accountabilityandprecautionsofmisjudgedcriminalcases.Partoneisliteraturereview.Firstly,whatisthemisjudgedcriminalcase?Itisthiskindofcasewhoselegalconsequencesareagainstthetruthorthejudgmentbecauseofcognitionerroroffactsorerroneouslawapplicationbythejudicialauthorities.Secondpartisaboutthedefinitionoftheconnotativemeaningsofmisjudgedcasesincriminalinvestigation.Wecand
