信用卡法律问题研究 （硕士论文摘要） 本文主要从信用卡各方间法律关系入手，探讨持卡人、发卡机构、特约商店间之法律关系，厘清他们之间的法律关系以及权利义务，界定了信用卡领用合约的性质。本文同时也研究了我国信用卡实务中比较重要的法律问题，指出了现行实务的不足，并提出了完善的建议。全文分为4个部分： 第一章主要界定了信用卡的含义，指出信用卡所应具有的一些基本功能。结合本文的写作目的，对信用卡进行了分类。接着本文概述了信用卡交易的基本流程，并在此基础上重点探讨了信用卡各方当事人间的关系。本文系以实务为基，故只研究持卡人、发卡机构和特约商店间的法律关系，明确了他们之间的权利和义务。在本章中，作者对各家学说进行了总结，结合我国的实践指出各种学说的不足之处，并提出了自己的观点和看法。 第二章研究信用额度和保证责任的问题。因目前申领信用卡，多数发卡机构要求提供担保，此时保证人承担保证责任的范围应如何界定？是对信用卡项下的所有债务承担保证责任还是以信用卡信用额度为限抑或其他，如何才能对保证人的合法利益进行保护，本文提出了自己的看法。 第三章研究信用卡冒用。信用卡因遗失或被窃而生冒用问题。信用卡冒用对持卡人、发卡机构和特约商店间关系影响甚大，往往在各当事人间生许多纠纷。本章概述了我国目前信用卡冒用的风险分配模式，指出其不足，并在参考我国台湾地区立法例的基础上提出了完善的建议。同时本章还探讨了特约商店在信用卡冒用中的善良管理人之义务和持卡人对信用卡的保管义务，以期能最大限度的降低信用卡被冒用之可能性。 第四章研究了信用卡的循环信用和利率问题。因为其对持卡人的利益影响巨大，文章指出了我国目前在信用卡循环信用利率上存在的诸多问题,包括对银行利益保护过度，对持卡人的利益保护不周。本文就此提出了自己的看法。 [关键词] 信用额度 保证责任 循环信用利率 信用卡冒用 法律关系 Study on Credit card legal matter (abstract) This paper mainly discussed the legal relationships between such legal subjects, including cardholders, card-issuing institutions and special merchants，to clarify the legal relationship between themthe rights and obligations, and determined the contract nature of the credit card. This paper also studied the the more important legal issues on the practice of Chinas credit card , pointed out the shortcomings of existing practices and made recommendations to improve. The full text is divided into four parts: The first chapter defined the principal meaning of credit card, and pointed out some basic functions that the credit card should possesses. Combined with the purpose of writing this article, we classified the credit card. This article then provides an overview of the basic process of the credit card transaction, based on which, we discussed the relationship between all credit card subjects. In this chapter, we summarized various theories, and put forward some views and perceptions. The second chapter focused on the issues of Credit limit and guarantee responsibility. How to defined the guarantee responsibility scope of guarantor, according to th
