内容提要 赦免制度作为刑罚消灭制度，具有与严苛法律相反的特点，通过对重刑和 酷刑的离弃，体现了任何事物及国家的运作皆是一张一弛。赦免制度是古今德政 的体现，具有缓解法律之严苛、弥补法律之不足的功用。适当运用赦免制度，还 能促进社会和解，维护社会稳定。因此，赦免制度在中国法制发展史及社会发展 进程中发挥着不可低估的作用。 发展至今的赦免制度并非一蹴而就，而是经过了历史的考验。汉代是我国封 建君主专制政体的形成时期，也是中国赦免制度的确立时期。因此，汉代赦免制 度的运作，对巩固封建君主专制政权，健全中国法制具有重要意义。同时，汉代 经济的发展、主流意识的变化、统治政策的调整，都为赦免制度的确立提供了可 能。 汉代赦令的颁行具有名目多、次数频繁、程度不同的特点，奠定了后世赦免 制度的基础。汉代赦令颁行的盛况空前，展示了封建皇权的至高无上，体现了赦 免制度的实质。由于皇帝绝对控制赦免权，下达赦令并非是科学、民主决策的产 物。汉代赦免制度难免存在弊端，赦免制度如同一把双刃剑，利弊共存。因此， 只有正确认识赦免制度的功能和弊端，趋利避害，才能真正发挥赦免制度的作用。 关键词：汉代 简牍 赦免制度 探析 II Abstract The pardon system, an institution of penalty abolition, stands in contrast to the harsh laws and decrees.
