Broadly implicates – standing; mootness; 11th Amendment concerns; Abstention doctrine; Declaratory Judgment standards under Steffel and Wycoff. Damages? Municipal liability; FTCA; Bivens; and § 1983 Individual capacity suits Injunctive Relief? Municipal liability; § 1983 Official capacity suits; § 2283; Younger; § 1341 For a violation of WHAT? How has plaintiff been injured? Broadly implicates – standing; mootness; attorneys’ fees; federal common law; implied causes of action; Bivens; § 1983 actions; § 1985 Who is our Defendant? Federal officers – Bivens; FTCA; In re Nagle (protective jurisdiction and federal common law); Westfall Act, Official immunities (for individual capacity suits).
