内 容 摘 要 由于各种原因，属于社会权体系的公民住宅权一直未受到人们的重视，而体现着国家和政府责任的住宅权却是公民应当享有的一项基本人权。目前，我国房地产市场价格一直居高不下，我国城镇居民尤其是中低收入阶层的住宅问题愈发成为社会的热点问题，可以说国家和政府在公民住宅权保障方面并没有尽到其应尽的义务，这也促使我们要加强公民住宅权保障方面的理论研究。本文试图从人权理论入手，深入分析公民住宅权的基本内涵及其保障的必要性和方式。通过借鉴住宅权基本理论的阐述以及对其他发达国家对公民住宅权保障制度的比较研究，并结合我国公民住宅权保障制度中所存在的缺陷，对我国应如何构建公民住宅权法律保障制度提出一些政策和法律上的建议。 本文分为四个部分：第一部分，将人权理论作为文章的切入点，简单阐述了人权的基本内涵，提出以住宅社会保障法律制度实现公民住宅权。第二部分，以我国公民住宅权利保障的现状为基础，来揭示我国住宅权利保障的制度性缺陷和在具体住宅社会保障制度运行中存在的问题。第三部分，通过对西方发达国家的住宅社会保障法律制度的分析，总结出我国应借鉴的经验。第四部分，提出完善我国住宅保障制度的法律建议，在立法思路的基础上，提出具体的制度措施。 关键词：住宅权，住宅权保障，法律建议 Abstract Because of various reasons, the right to adequate housing which belongs to the system of social rights has not been given much attention, and the right to adequate housing as a basic human right states much more government’s responsibility. The housing problems of urban residents in current china, in particular, middle and lower income class, increasingly become a hot issue in society. The obligations of protection of the right to adequate housing have not been fulfilled by the country and the government, and this has prompted us to strengthen theoretical research in the field of the protection of the right to adequate housing.This paper attempts to start from the theory of human rights, deeply analysis the basic content to the right to adequate housing and the necessity to protect it, by drawing on the international standards of the right to adequate housing and comparatively studying the system of other developed countries to protect their citizens’the right to adequate housing, and considering the defects which exist in China’s protection to the right to adequate housing, and then , promotes the suggestions to policies and law that protect the citizens’right to adequate housing.
