權利的界限(98年版) 動物有權利嗎? 東吳政治系 許雅棠編寫 什麼是權利？ 「權利Right創造出一個集中於權利所有者，也是由他掌控之下的治與被治者互動的領域。」8 「宣稱一種權利便能『讓事情發生』。」 它包含了行使、尊重、享用和強制四個面向。 Rights 只有爭議才會提到權利，在一理想世界，彼此尊重，不會興起權利要求，當宣稱要求權利即是身處某種權利缺乏之時(此謂之possession paradox)10。 「權利是『最後憑藉的手段(resort)』」12。(以上引自Universal human rights in theory and practice ) 自古以來各個歷史文明只是從道德上期求人要善待他人種種(如公平對待、仁民愛物、公正審判、不欺不害等等) 權利的特質則是透過公權力機關和人員強制他人或團體機構必需尊重、保護，以至於擴展權利擁有者法律明文規定的權利要求與享用。 所以，權利是對他者(個人或機關)的強制課責。具有強烈的抗爭性格。 這種權利觀乃源自西方近代以來人與人長久鬥爭經驗和思想結晶，它十足反映著西方人看待人的尊嚴的基本方式。 如《世界人權指南》的作者C.
