毕业论文PAGE 政府信息公开中的个人隐私权保护研究 PAGE 1政府信息公开中的个人隐私权保护研究[摘 要] 法治社会、阳光政府的理念要求政府信息能够得到最大限度地公开，以满足公共利益的需要。但公共利益的实现不应当以牺牲私人利益利为手段，政府掌握的事关私人利益的信息应该得到保护，这其中就包括了个人隐私。如果隐私权在政府信息公开的法律制度下被随意践踏，那么这种制度本身的合理性、合法性就值得怀疑。本文以阐述政府信息公开中隐私权的特征及内容为起点，分析了在政府信息公开视角下保护个人隐私权的必要性，在此基础上通过梳理我国现行政府信息公开立法对隐私权保护的现状，探究其中存在的主要问题，最后借鉴国际上的立法经验，针对存在问题分别从立法层面、行政程序以及法律救济三个方面提出完善我国政府信息公开中个人隐私权保护的制度构想。[关键词] 政府信息公开；个人隐私；隐私权；利益平衡Privacy Protection in Government Information Disclosure SystemAbstract: In order to enhance the transparency of our government and build China into a country of nomocracy, the information held by government should be maximally disclosed to meet the needs of public interests. However, the realization of public interests should not sacrifice private interests. That means the information held by government which contains privacy should be protected. If privacy is violated arbitrarily under the government disclosure system, then the system is not rational and legal. This paper discussed how to protect privacy in the government information disclosure system. Firstly, it talked about the features and content of privacy and analyzed the importance to protect privacy in government information disclosure system. Secondly, by summing up the current laws about privacy protection, it found out the existing problems and difficulties.
