摘要史沿革。首先，分析安全保障义务的安全保障义务的理论来源。该制度设计最早可追溯至罗马法，研究罗马法中的安全保障义务理论、尤其是其“善良家父”标准，至今仍有现实意义。我国作为大陆法系国家，现行的安全保障义务主要以借鉴德国侵权法中的一般安全注意义务形成，因此，在探究大陆法系安全保障义务的理论渊源以德国法为例，研究德国法中安全保障义务的制度安排。同时，分析英美法中有关安全保障义务的理论，拓宽安全保障义务的理论基础，丰富安全保障义务的内涵。其次，结合不作为侵权的相关理论--基于一般注意要求引起的义务，论述安全保障义务的立法依据，主要有义务需求说（社会责任理论要求）、准社会契约要求说、公序良俗需求理论等，结合山岳型景区侵权纠纷的特点，着重以违反一般注意义务引起的不作为侵权责任为主。第四章安全保障义务的界限确定。采用案例分析的研究方法，结合具体案例，从四个方面论述山岳型景区应负的安全保障义务边界如何确定：首先，明确山岳型景区安全保障义务适用范围，主要为主体、空间、时间。其次，探析山岳型景区应负安全保障义务的内容，从山岳型景区的物件安全保障义务、人员安全保障义务、制度安全保障义务三个方面着手，具体包括：信息预警、风险告知、设施设备、事故救援、景区管理等。再次，确定山岳型景区安全保障义务合理边界确定的基本原则。最后，分析山岳型景区安全保障义务边界必须考量的其他问题。关键词：山岳型景区；安全保障义务；合理边界IIAbstractInrecentyears,withtherapiddevelopmentoftourisminourcountry,thenumberoftouristsincreased,tourismdesignscopegraduallywide,touristssufferedpersonalpropertydamageintheeventoftourismscenicspotsgraduallyfrequent.However,theexistinglegalnormsontheareaofsafetyguaranteeobligationonlymadeprovisionsinprinciple,allpracticedifferinthousandsofways,causesbetweenthetouristsandscenicareasofthedisputeisnotagoodsolution.Thesecurityobligation,theconcept,referstotakereasonablemeasurestoscenicspotsaspublicactivitiesmanagementorganizationalunitforthetouriststosafeguardthepersonalandpropertysafety,benefitfromdamageobligation.Cleartheobligationofsecurityboundaryisaneffectivesolutiontothekeytourismdisputeshavebecomeincreasinglyprominent,especiallythemountaintypescenicarea,thenaturalenvironmentiscomplex,therequirementsofsecurityobligationsofthescenicareamanagementisdifferentfromotherpublicmanagementofpeople,onlyclearmountaintypescenicareasafetyguaranteeobligationboundary,canplayaneffectivesetdisputeresultsinpractice.Therefore,thispapertakesYuntaiMountainasanexample,usingtheresearchmethodofsemanticanalysismethod,comparativemethod,combinedwiththetheoriesandjudicialpractice,thereasonableboundaryanalysisofmountaintypescenicspotofsafetyandsecurityobligations,providesupportlimitedtheorytosolverelatestothemountaintypescenicspottheobligationofsecuritydisputes.Besidesprefaceandepilogue,thisarticle
