外籍人士在华购房置业跟法律实务

购买商品房的条件 购房人的资格:境外机构的在华分支机构和代表机构(房地产企业除外);在中国境内工作、学习时间超过一年的境外个人;港澳台居民和华侨。 购房类型:商品房(不可以购买公房和经济适用房) 购房用途:自用、自住 采取实名制(同时注明中文和外文姓名),并持有效证明(中国批准来中国工作、学习的证明) 特别提示:目前,京津地区已经暂停执行限制外籍人士在该地区购房所需的居住年限和所购房屋数量的政策。 Requirement for Real Estate Transactions Buyers’ qualifications: Chinese branches and agencies of external institutions (except for real estate companies), foreigners working or studying in China over one year, Hong Kong, Macao and Taiwan residents and overseas Chinese. Type of housing: commercial housing (public housing and economical housing are not allowed to purchase) Purchase purposes: personal use Real-name requirement :(both Chinese name and foreign name), valid certificate are also required (certificate of China’s ratification of foreigners working and studying in China) Special note: at present, it is suspended that the policy of restrictions on foreigners’ transaction requirements which are residential time and the number of housing purchasing in Beijing-Tianjin Area. 所需证件、文书 身份证明 译名公证或《工作证》 有效居住证证件(需同时注有中文及外文姓名) 向国外及港澳台人员租、售房屋审批表 《委托书》 以上证件、文书非中文书写的文件,需到具有翻译资格的翻译公司翻译,应同时附经公证和认证的中文译本,程序:经该外籍人士所在国公证机关公证,且经中国驻该国使、领馆认证。 Certificates and Documents Needed Identification paper Notarization of Chinese name or working license Valid residence permit (both Chinese name and foreign name) Approval form for housing rent and purchase with foreigners and Hong Kong, Macao and Taiwan residents Power of Attorney Certificates, documents and other non-Chinese papers should be translated by qualified translation companies and be enclosed the notarized and authenticated Chinese edition.
