I 摘 要 我国的案件流程管理（也有称审判流程管理）是法院审判管理改革的产物， 它与审判方式改革一道，使我国法院的审判机制改革形成“双轮”驱动的局面， 为促进司法公正，提高司法效率发挥积极作用。但与该项制度发达的国家相比， 我国的案件流程管理制度起步晚（上世纪九十年代中期），尚处于发展和完善的 初级阶段，由于理论研究和立法滞后的先天不足，使制度设计很不完善，制度运 行状况不佳，制约了制度功能的充分发挥。本文从我国 10 年来案件流程管理制 度实施的实际情况出发，从分析其法理学基础入手，并运用与制度发达国家比较 研究的方法，试图提出我国案件流程管理制度重构的基本路径，但限于篇幅，本 文仅就该制度重构中几个突出问题进行了初探：一是合理划分流程阶段的问题； 二是专门机构管理问题；三是制度运行的监督管理问题。四是法官职业化问题。 在上述分析的基础上，针对制度运行几个相关问题提出了初步设想：一是科学设 立调解程序；二是加强对当事人的举证指导；三是改善内外环境；四是建立“网 上电子警察”系统承载流程管理。 关键词：案件流程管理；缺陷；重构 II ABSTRACT In our country, the flow management system of case(namely, the flow management system of trial )is the product of the management reform of court’s trial, and with the reforming of trial’s form, in common, they make the system reform of our court’s trial shape the situation of “two-wheeled driving”, and the system plays a positive role to promote impartial judicature, improve justice’s efficiency. However, compared with this system in developed country, the system in our country starts later (in the mid-1990), it belongs to the primary stage of developing and perfection. Because of the congenital defect of theoretical investigation and legislation, it was designed imperfectly, run in bad state, therefore, its function was be restricted. From actual implementation of this system in the ten years, the essay tries putting forward the basic line of this system’s reconstruction, however, space lacks for a detailed description of it. The essay only explores some especial problem of its reconstruction: The first is to divide process stage rationally. The second is organization management specially. The third is supervise and environment conditions within and without under the system’s function. The last is Judge’s professional issue. Furthermore, the essay introduces the primary assume concerning some interrelated problems. Firstly, the conciliation procedure should be built scientifically.
