第二章 中国食品法律法规 适用对象范畴 食品安全监管体制 食品安全风险监测与评估制度 食品安全标准的统一 生产经营者是食品安全的第一责任人 食品检验 监督管理 食品安全事故的处理 法律责任 我国的食品安全监管体制 分为三个层次： 第一层次是县级以上地方人民政府——政府负总责 统一、负责、领导、组织、协调 第二层次是县级以上卫生行政部门——上传下达、承上启下 第三层次是县级以上分段监管部门——负责具体落实 强调了两点： 监管部门的权责一致的原则； 各个监管部门应树立大局观念，要相互配合做好衔接，加强沟通、密切配合，形成合力，做到环环紧扣避免出现监管漏洞。 国务院卫生行政部门承担食品安全综合协调职责，负责食品安全风险评估、食品安全标准制定、食品安全信息公布、食品检验机构的资质认定条件和检验规范的制定，组织查处食品安全重大事故。 国务院设立食品安全委员会，其工作职责由国务院规定。设综合司、协调指导司、监督检查司、应急管理司。组织开展重大食品安全问题的调查研究，并提出政策建议；组织拟订国家食品安全规划，并协调推进实施；推动健全协调联动机制、完善综合监管制度，指导地方食品安全综合协调机构开展相关工作；督促检查国务院有关部门和省级人民政府履行食品安全监管职责，并负责考核评价；指导完善食品安全隐患排查治理机制，组织开展食品安全重大整顿治理和联合检查行动；推动食品安全应急体系和能力建设，组织拟订国家食品安全事故应急预案，监督、指导、协调重大食品安全事故处置及责任调查处理工作；规范指导食品安全信息工作，组织协调食品安全宣传、培训工作，开展有关食品安全国际交流与合作； 美国的食品安全监管体制 Canada The Canadian Food Inspection Agency(CFIA) provides all federal inspection services related to food(production from primary production to the retail level) and enforces the food safety and nutritional quality standards established by Health Canada. Promoting the nutritional health and well-being of Canadians by collaboratively defining, promoting and implementing evidence-based nutrition policies and standards. Administering the provisions of the Food and Drugs Act that relate to public health, safety and nutrition.
