城镇化背景下的农村“土地利用”法律制度的研究-民商法学专业论文.docxVIP

摘 要 城镇化实施成功的关键在于农村土地的有效利用，在法律上即需要构建以农 村“土地利用”为核心的法律制度。通过考察目前农村“土地利用”法律制度的 背景、现有农村“土地利用”法律制度运行中存在的问题、城镇化与农村“土地 利用”法律制度的关系及农村“土地利用”法律制度的具体实践，笔者认为农村 “土地利用”法律制度在现有的法律体系下通过修改和完善即可实现土地有效利 用的目的，进而促进我国城镇化战略的实施，保障农民的合法权益。 本文第 1 章主要对本文所欲研究的主题及既有的研究进行简要的介绍。第 2 章从土地所有制的演变角度考察了中国农村“土地利用”法律制度的制度背景， 并介绍了农村土地的相关法律规定和运行情况。第 3 章讨论了为什么要在城镇化 背景下提出农村“土地利用”法律制度的问题。第 4 章介绍了城镇化下的农村“土 地利用”法律制度的具体实践，包括土地信托、地票制度及农村土地交易所法律 制度。第 5 章是对既有的农村“土地利用”法律制度的评价。第 6 章是全文的结 论部分，总结了本文的研究成果。 关键词：城镇化，土地利用，法律制度，改良 Abstract The key to the success of Urbanization lies in the effective implementation of rural land-use legal system. By examining the current rural land law, Collective ownership of rural land and the problem of existing legal provisions,I propose to build land trusts, land ticket system and rual land exchange system.My study shows that land-use system can be made by modifying and improving the existing legal provisions.If we succeed,we can promote the implementation of Chinas urbanization and protect the legitimate rights and interests of farmers. Chapter 1 briefly introduces the background and the main content of the article. Chapter 2 examines the historical evolution of Chinas rural land law from the perspective of land ownership, and introduces the legal status and operation of rural land law system. Chapter 3 discusses the relationship between Urbanization and land-use legal system.Chapter 4 discusses the specific system of land trusts, land ticket system and rual land exchange system. Chapter 5 is the evaluation of the existing rual land system. Chapter 6 is the last part of this article, which summarizes the main ideas and comes to conclusions.
