摘要 l 川川川阴阳刚刚刚 l \ Y184 .) 摘要 随着国际贸易的不断发展，规避反倾销措施的行为出现的数量也与日俱增， 规避行为的形式也不断发展，这促使反规避问题的研究也就成为各国研究的热 点问题。美国是反规避立法和实践的先行者，在上世纪 80 年代，英国就制定了 反规避条款。在这近 30 年罩，美国积累的丰富的立法和实践经验，因此美国的 反规避制度也就成为了我们研究的重点，也将是今后我国反规避立法不可戒缺 的借鉴对象。 我国反倾销立法与实践尚不成熟，对作为其延伸和发展的反规避立法更是 极为简陋，远远不能满足现实的需要。在我国贸易总额不断攀升的大背景下， 这无疑会影响我国经济的持续稳定增长。因此，尽快完善反规避立法势在必行。 本文首先探讨了与反规避相关的一些理论问题，然后选择美国反规避制度 作为研究对象，最后阐述了美国反规避制度对在构建我国反规避法律制度过程 中的重要启示。 关键词:规避:反规避:倾销;反倾销 11- Abstract ABSTRACT Wi伽 the continuous development of intemational trade，the circumvention of antidumping measures are increasing day by day，and the way to circumvent also changes 仕equently.All these factors prompt the research on Anti-circumvention becoming a hotspotsωevery country. In the past 20 years，the United States has accumulated rich experience in legislation and practice ， so American anti-circumvention legal system becomes an important 0战ject of our research.And it also will be will be an indispensable reference to our future anti-circumvention legislation.
