论文编号： 中国政法大学 本 科 生 毕 业 论 文 略论日本法律近代化的进程与启示 学 号：2011201086 专 业：法学 姓 名： 王津 学 院：民商经济法学院 年 级：2011级 指导教师: 郭琛 完成日期：2015年4月 论文成绩： 略论日本法律近代化的进程与启示 【摘要】 日本和中国同属东亚文化圈，具有极大历史渊源。19世纪，当两个国家同样面临外国列强的侵略之时，日本依靠明治维新实现了近代化，单从法律近代化的角度来看，日本仿照西方建立了近代化法律体系，并最终使本土文化与外来法律制度融合，为其后来的社会发展打下了基础；同时期的中国为改变内忧外患的局面，也曾大量移植西方的法律。但却最终失败，这样的差异应当引起反思。即使是在今天，中国作为一个法律继受大国，对于被认为是成功移植外来法律制度典范的日本，仍有许多需要借鉴和学习之处。本文旨在通过论述日本近代化以前的法律文化特质、日本法律近代化的过程及其成功与不足，来反映法律移植的一些规律，以期为我国的法制建设总结经验、予以借鉴。 【关键词】日本 法律近代化 法律文化特质 法律移植 启示 On the Japanese legal process of modernization and enlightenment 【Abstract】 Japan and China belong to the East Circle with great history.19th century，when the two countries also face the aggression of foreign powers，Japan relies on Meiji Restoration to achieve the modernization of the society，just from the perspective of legal modernization，Japan modeled the modernization of the West established a legal system，ultimately achieved the local culture and foreign legal system’s integration，and made a foundation for its subsequent social development. in China，in the same period of internal and external situation，we also had a lot of legal migration，but ultimately fails. we should rethink such differences profoundly. Even today，China still has lots of legal transplantation activities. As a successful model of Legal Transplantation there is still a lot to learn from the Japan.
