燕山大学 毕 业 论 文 行政行为合法性与政府执政能力研究 摘 要 行为合法性是近年来的一个讨论比较多的话题，其对于提高政府的执政能力有着重要作用。随着社会的发展和对政府执政行为的关注，目前行政行为的合法性更多的与政府的执政能力联系在了一起。本文将行政行为合法性建设引入到提高政府执政能力的研究中，为提高政府执政能力作一点探讨。 只要有行政管理活动存在，就会有行政争议，要绝对避免行政争议的发生是不可能的，要回避行政争议的存在也是不现实的，本文通过介绍行政行为合法性的一般概念和思想，并揭示当前我国政府行政执行存在的主要问题，最后针对这些问题并结合理论提出一些建议及对策，并将行政行为的合法性与政府的执政能力的关系引入到提高政府执政能力的研究中，为行政行为的合法性建设提供理论依据,从而提高我国政府的执政能力。 关键词　行政行为合法性；政府执政能力；行政争议 Abstract The validity of administrative action is one of the topics that have been talked frequently in recent years. It plays a vital role in enhancing government’s ruling ability. Along with the development of the society and the attention to the government being in power behavior, the validity of administrative action is more and more related in governments ruling ability. In this paper I lead the validity of administrative action into the construction of enhancing the government’s ruling ability, and propose some views for the government’s ruling ability. So long as there are administrative activities, there are disputing administrations. It is impossible to avoid the occurrence or the existence of disputing administrations. I have introduced the general concepts of the validity of administrative action and the main questions of our government’s administrative execution currently. Finally，according to these problems I make some suggestions and countermeasures and lead the validity of administrative action into governments ruling ability , for providing the theory basis on the construction of validity of administrative action and enhancing our government’s the ruling ability.
