首都经济贸易大学硕士学位论文工商行政部门市场监管模式研究 首都经济贸易大学硕士学位论文 工商行政部门市场监管模式研究 首都经济贸易大学硕士学位论文工商行政部门市场监管模式研究 首都经济贸易大学硕士学位论文 工商行政部门市场监管模式研究 自党的十六大以后，我国政府已明确将经济调节、市场监管、社会管理和公共服 务作为政府的四项基本职能。其中市场监管是政府在经济领域的重要职能，其职能能 否履行到位，对有序市场体系的建立、市场经济的健康发展和社会主义市场经济体制 的完善都是至关重要的。随着管理学和行政管理学的不断发展，学者们已普遍认同政 府职能并不会自动实现，必须通过合理的方式才能高效的发挥政府的职能作用。因此， 如何将理论上的政府职能转化为实际上的政府职能，即所谓政府的管理方式，也逐渐 成为理论界研究的重心。在众多具有监管职能的监管机构中，具有综合性监管特征的 工商行政部门因其监管内容综合性强，监管领域广泛性大，和监管过程完整性高等特 点，在政府的监管机构中无疑具有典型性，其监管水平的高低在一定程度上可以体现 我国整体监管水平的高低。而工商行政市场监管职能已经明确，其模式的选择就决定 了其职能履行能否到位。 目前，国内关于工商行政部门市场监管模式的研究从理论方面看主要是集中在市 场监管模式的研究，并没有专门对工商行政部门进行研究。从实践方面看，主要是工 商行政部门系统内部的工作人员根据日常的工作进行经验总结。本文从工商行政部门 的视角出发，分析了传统监管模式的发展历程、适应性以及目前劣势，并提出了完善 规律性市场监管模式的可行性和必要性，以此说明工商行政部门市场监管模式转型对 政府市场监管职能履行到位的影响，同时从工商行政部门自身、立法和辅助等方面提 出了相关建议。本文主要采用了历史分析、文献研究、比较分析等方法。 关键词：监管 工商行政部门 市场监管模式 Abstract Since the 16th CPC National Congress, our government has made it clear to economic regulation, market supervision, social management and public service as the four basic functions of the government.
