( ) 　　　　　　　　　　　　　　　法律科学 西北政法学院学报 　　　　　　　　　2005 年第 3 期 ·72 · 　文章编号 :167 169 14( 2005) 030072( 11) 财产性利益是诈骗罪的对象 张明楷 ( 清华大学法学院, 北京 　100084) [ 摘 　要] 　主张财产性利益是诈骗罪的对象 , 具有合 目的性与具体的妥当性 , 并不违反罪刑法定原则( 不属于 类推解释) ;但是 , 只有当某种利益内容属于财产权 , 具有管理可能性与转移可能性 , 客观上具有经济价值 , 被害人 丧失该利益必然同时导致财产损害时, 该利益才能成为诈骗罪对象的财产性利益;至于债权凭证 、财物的返还请求 权 、货款请求权 、财物的交付“请求权”、债务的延缓履行是否刑法上的财产性利益 , 则需要具体分析 。 [ 关键词] 　诈骗罪;犯罪对象;财产性利益 Abstract :The allegation t hat t he interest of prop erty is t he obj ect of t he crime of swindling accords wit h t he aim of t he criminal law , has t he concrete appropriateness , and does not violate t he principle of a legally prescribed punishment for a sp ecified crime (not belonging to analogical interpretation) ; however , t he interest could not satisfy t he element s of t he interest of t he prop erty which is t he obj ect of t he crime of swindling unless it s content is p art of t he prop erty right , has t he quality of manageability and transferability , possesses economic value , and inevitably leads to prop erty detriment simulta neously when t he victim is deprived of t he interest . As to t he certificate of creditor ’s right s , t he claim for money or prop erty’s restitution , t he claim for p ayment , t he claim for money or prop erty ’s delivery , and t he deferred p erformance , whet her all of t he above are t he interest of prop erty in t he criminal law or not , need sp ecific analysis under different condi tions.
