《植物新品种保护公约》的历史过程、立法依据和
现实影响

摘 要:《植物新品种保护公约》是保护植物育种者权益的重要国际协定。它的产生既是生物科学技术发展和育种科技成果商业
化的必然要求,也是国际育种业利益调整的现实选择。其主要的法律基础在于保护育种者的合法权益,推进育种业科技的可持
续创新。《植物新品种保护公约》虽然存在一定的局限性,但在保护育种者权益,协调育种者和用户之间的利益方面具有相当的
可行性,而且在技术方面能有效地解决新品种认定的难题,因此是当前各缔约国默认的“有效制度”。

Abstract:TheConventionontheProtectionofNewPlantVarietiesisanimportantinternationalagreementforprotectingtherightsof
breeders.Itistheresultofthedevelopmentofbiotechnologyandcommercializationofplantvarieties,aswellastheadjustmentofinterestof
internationalseedindustry.Itaimsatprotectingtherightsofbreedersandpromotingtheinnovationofplantbreeding.Althoughtherestillbe
someinsufficiencyinUPOV,ithasitsownstrongpointintheprotectionofbreedersinterestandharmonizationtherelationshipbetween
breedersandusers.Furthermore,italsoresolvedtechnologicaldifficultiesintheidentificationofnewplantvarieties.Therefore,UPOVhas
beenconsideredastheeffectiveregimebyitsmembers.
