环 境 司 法 与环境损害评估 Environmental Judiciary Environmental Damage Assessment 法 律 规 定 Legal provisions 《中华人民共和国民法通则》 General Principles of the Civil Law of the People’s Republic of China：  第一百二十四条 违反国家保护环境防止污染的规定，污 染环境造成他人损害的，应当依法承担民事责任。 Article 124: Any person who violates of state provisions for environmental protection and the prevention of pollution, pollutes the environment and causes damage to others, shall bear civil liability in accordance with the law.  第一百三十四条 承担民事责任的方式主要有： （七）赔 偿损失； Article 124: Methods of assuming civil liabilities shall include: (7) Compensation for the losses. 法 律 规 定 Legal provisions  《中华人民共和国侵权责任法》 Tort Liability Law of the Peoples Republic of China.  第二条 侵害民事权益，应当依照本法承担侵权责任。  Article 2 Those who infringe upon civil rights and interests shall be subject to the tort liability according to this Law.  第十五条 承担侵权责任的方式主要有：（六）赔偿损失；  Article 15 Methods of assuming tort liabilities shall include: (6) Compensation for the losses. 法 律 规 定 Legal provisions  要赔偿损失，就必须要确定损害后果的大小（多少）， 从诉讼法的角度而言，原告应当要向法庭提交相关方面 的证据。  To compensate for the losses, we must determine the amount of damage already caused (how much); from the perspective of the procedure law, the plaintiff shall submit the relevant evidence to the court.  司法实践中，法官往往会对损害后果进行鉴定或评估。  In judicial practice, the judge will often make the appraisal or evaluation of the consequences of damage. 法 律 规 定 Legal provisions  但在司法实践中，由于对鉴定、评估机构有资质要求，而 我国环保部、司法部均未授予任何机构司法鉴定资质，所 以环境污染损害评估成为制约环境司法
