y y 57133$ 内容摘要 文章阐述了建设工程设计合同有关理论，通过对建设工程设计合同中存在问题的 表现和原因进行分析，探讨了设计合同有关问题的相关对策。全文共分为三部分。第 一部分，建设工程设计合同一般理论。在理论上阐述了建设工程设计合同的含义、订 立、当事人权利义务、违约责任等问题。第二部分，建设工程设计合同中存在的问题 及原因分析。通过对建设工程设计合同运行过程中的问题进行分析，归纳工程设计合 同存在问题的原因。第三部分，建设工程设计合同有关问题的对策。结合我国建筑设 计市场的现状，探讨了建设工程设计合同有关问题的具体策略和办法，并对于如何操 作提出了建议。 笔者希望通过文章表述的主要观点：一是进行了建设工程设计合同原理的理论阐 述；二是通过对建设工程设计合同运行过程中存在的问题进行分析寻找其形成原因 三是在分析合同问题原因的基础上，探讨了建设工程设计合同有关问题的防范和应对 策略。并就如何操作提出了一些新颖的观点，对于解决工程设计合同运行中一些实际 问题具有一定的指导意义。 关键词 建设工程 设计合同 问题 对策研究 AbstractThis Abstract This paper gives firstly all explanation of the related rules on the architectural project contract，and further carries on a study on the related measures to the corresponding issues consisting in the design of contract through an analysis of its presence and reasons and presence． This paper consists of three parts．The first part introduces the general principles for the architectural project contract,and in theory explains such issues in the architectural project contract as the meanings and the subscription of the architectural project contract，the rights and obligations of the contractors，the obligations for the break off,etc．the second part gives all analysis on the issues existing in the architectural project contract and further concludes the reasons for tlle existing of the issues．the last part carries on a smdy on the concrete measures and ways to the corresponding problems consisting in the design of contract in line with the actuality of the architectural project market． The major contents that the author wants to deliver in this paper conclude： a． an explanation of the principles for the architectural project COntract， b．an analysis the issues existing in the architectural project contract and the conclusion of the reasons for the existing of the issues． C．a study on the concrete measures and ways to the corresponding issues consisting in the design of contract in line with the actuality of the architectural project market． Keywords： architectural project projec
