鉴定结论在刑事诉讼中具有重要的作用，可以帮助司法人员认识案件 鉴定结论在刑事诉讼中具有重要的作用，可以帮助司法人员认识案件 中的专门问题，具有补充法官认识能力、推动诉讼进行的作用；鉴定结论 可以使其他证据更好的发挥证据价值；鉴定结论是审查判断其他证据的重 要手段，即印证和补强作用。需要指出的是，在实践中，对待鉴定结论要 防止过分相信其科学可靠性，鉴定结论本身也可能有错，也要进行有效的 审查判断。 第三部分：鉴定结论的审查 鉴定结论毕竟不是判决，特别是近些年来，由于管理上的不规范和一 些鉴定人员素质不高，在具体进行鉴定和适用鉴定结论方面存在混乱现象， 一定程度上影响了鉴定结论的正确性，这样的状况势必给案件的质量带来 影响，所以对于鉴定结论一定要认真审查． 鉴定结论主要从鉴定主体、鉴定材料、鉴定设备方法以及鉴定结论的 形式和内容等方面加以审查。其审查方法主要有调查咨询方式，庭审时的 交叉质证方式，以及补充鉴定和重新鉴定的方法。 我国鉴定结论质证存在着诸多问题，针对种种问题，笔者认为，确 立合理有效的质证模式需要做以下三个方面的工作：第一、构建均衡合理的 质证主体结构；第二，建立刑事诉讼专家辅助人制度；第三、完善鉴定人 出庭接受询问的制度。 AbstractAs Abstract As a series of cases occurred in recent years，more and more people pay attention to the expert evidence．Most of them aim at the insufficiency of expert evidence，which has received the unprecedented questions． Be,cause of its content deficiency,there are lors of differences in the theory and the judicial practice．The author attempts to elaborate own viewpoint about the related question of expert evidence．ThiS article can be divided into four parts，with approximately 30，000 characters． Part one：Outline of the expert evidence According to the appraisal object,expert evidence can be divided into four kinds．ne expert evidence has the producer particularity and the scientific nature．Its object is the case technicality question，and the solution is the fact question not the legal matter． Part two：Essence of the expert evidence Evidence concept and defming of the evidence form are the premise of the essence of the expert evidence．It’S more accurate that evidence is defmed as the thing embodying the case fact information．The evidence should be the thing(generaiized thing)at the first level，because anything does not exist in the world except the moving thing．Evidence can be divided into human evidence and the thing(narrow sense thing)evidence at the second level． Expert evidence is one kind of independent evideace form．It iS the understanding of the expert to the correlated matter(appraisal objecO．Its the conclusion determining the correlat
