捅要 I金融监管是指国家根据有关法律授权有关部门制订和颁布有关金融业的组织结 构和业务活动的特殊规定或条例。从历史上来讲，人们对金融监管的关注和需求是 对金融危机的最为直接的反应。金融监管是为了纠正金融市场的种种失灵，避免系 统危机的发生和保护知情较少一方的利益，建立一个稳定、高效和公正的金融体 系。它是经济金融体系和资源配置过程有效运行的内在需要，而且也是社会公众和 金融机构利益的体现，是社会决策或公共选择的结果。 本文主要侧重金融监管的有效性分析，比较监管的成本和收益，考虑监管的方 使倒闭成为资源 第一部分是全文的基础，由l、2两章组成，首先论证金融监管的现实意义和 理论意义，对金融监管进行成本分析，接着参照美国的监管制度对有效金融监管的 基本组成要素作详细分析，然后论述了有效金融监管的结构安排必须考虑的三个方 面。 第二部分是全文的主体，由3、4两章组成，主要论述了当前形势下金融监管 面临的若干挑战，如金融国际化的挑战，衍生金融工具的挑战和金融混业经营的挑 战，以及面对这些挑战如何进行有效的金融监管，比如加强和深化金融监管国际合 作，强调外部监管和企业自律并重，监管的结构安排上向功能性统一监管演进等 等。 第三部分即第5章是在前两部分论述的基础上，借鉴国外的发展经验，对我国 如何进行有效金融监管提出一些建议。 关键词：金融监管有效性国际合作企业自律功能性；；％管 ／’ 分类号：F832．1 ABSTRACTFinancial ABSTRACT Financial regulation refers to the process of authorizing relevant government agencies to devise and put into effect rules and regulations concerning the organizational structure and business activities of entities in the financial sector．Historically，the significance and attention attached to financial regulation is direct reaction to financial crises．Financial regulation aims to correct various market failures in the financial industry，to prevent systematic crisis and protect the interests of clients，to help establish stable，effective and fair financial system．Financial regulation is the intrinsic need of healthy running of economic financial system and allocation，and is in the interests of both the public and financial organizations． This paper mainly focuses analyzing the effectiveness of financial regulation，by comparing its cost and benefit，and by considering financial regulation should consistently adapt to the changing circumstances，should not hinder the smooth running ofmarket force and should allow mild crises to better allocate The paper consists of 5 chapters and could be divided into 3 pars： The first part is made up ofchapter 1 and 2，first discussing the necessity of financial regulation and its cost，and then going to detailed analysis of the elements of contemporary financial regulation well as its structural arrangement． The
