PAGE 2 PAGE 1 论知识产权质权 摘要 在知识经济的今天优秀知识产权的价值不可估量，而以知识产权为标的出质作担保也为法律所认可。但实际操作中，成功以知识产权质押作担保的案例很少，其根本原因在于知识产权的评估难﹑变现难，同时法律在可以质押的知识产权种类上不明确，难以满足种类日益丰富的知识产权需要，而且现有的设质程序也不能满足所有的知识产权出质。本文从知识产权质权出发，围绕知识产权设质的流程，对影响知识产权价值的原因进行分析，对知识产权价值的评估的方式和质押生效后财产价值减少的处理进行探讨，对我国知识产权质押制度提出一些处理意见。 关键词：质押 知识产权质权 知识产权价值评估 知识产权质押登记 abstract In the knowledge economy today the outstanding intellectual property value immeasurable, and the intellectual property rights as the object of quality guarantee for legal recognition.
