精神病人犯罪后的人身管理及处置问题研究 XXXX学校XX学院XXX 摘 要 精神病人犯罪行为威胁群众安全感和平安建设,是当前社会管理面临的一个难题。尤其是近年来，我国精神病人实施的刑事犯罪案件也呈上升趋势且性质越来越恶劣，对社会的安定和谐造成了极其不利的影响。精神病人犯罪后如何进行处置是一项亟需探讨的课题，因为一旦处置不当将会很容易造成精神病人的反复作案，导致社会其他成员的合法权益受到侵害的严重问题。现实中存在的处置不当很大部分源于法律上的“空白”、强制医疗措施未能得到落实和政府的重视程度不够等等原因。我们应当重视完善相关法律，继续强化政府职能，坚持落实强制医疗制度，以更好地维护社会的稳定发展。笔者通过本文的介绍，其目的是为精神病人犯罪后的人身管理及处置问题进行一个深度研究，并提出笔者关于预防精神病人犯罪的意见建议。 关键词：精神病人；犯罪；鉴定；处置；预防 Abstract Mental patient crime threatens the public security and peace building, is a difficult problem faced by the current social management. Especially in recent years, the implementation of the criminal cases of mental patients in our country also showed an upward trend and the nature of the more and more severe, the stability and harmony of society has caused a very negative impact. Mental patients after committing the crime, how to dispose of is an urgent need to explore the topic, because once improper disposal will is likely to cause mental patients repeated crime, cause the legitimate rights and interests of other members of the society against the serious problem. The reality of the existence of improper disposal is mostly due to the law on the blank, compulsory medical treatment has not been implemented and the government dont pay enough attention and so on. We should pay attention to improve the relevant laws, to strengthen government functions, adhere to the implementation of compulsory medical treatment system, to better safeguard social stability and development. According to this article, the purpose is for psychiatric patients after the crime of personal management and disposal problems of a deep research, the author gives some suggestions on the prevention of crime and the spirit of the opinion of the patient. Key words: mental patients; crime; identification; disposal; prevention 前言 目前，我国目前有各类精神疾病患者超过1亿，重症精神病患者超过1600万。这意味着我国每13个人中就有1个是精神障碍患者；不到100人中，就有1个是重症精神障碍患者。而令人担心的是，我国仅有不足20%的重症精神病患者能够接受系统、有效治疗。有些精神病患者平常看起来和常人毫无二致，但当其中一些人面临就业、婚姻、子女、养老等生存压力时，其无助和挫折都可能成为一触即发的“引信”，瞬间点
