北京科技大学硕士学位论文摘 北京科技大学硕士学位论文 摘 要 众所周知，国有资产是匡【家得以存在、国家机器得以运转的物质基础，在政治、经 济和社会生活中占有举足轻重的地位和作用，而改革开放二十几年来，处于经济转轨中 的中国却一直面临着一个严酷和令人困惑的现实，那就是国有资产的流失且国有资产流 失现象之普遍、速度之J凉人、流失量之大，令人触目惊心。因此如何从法律上探讨遏制 和解决国有资产流失的剥策，采取有效措施防止和制约国有资产流失己刻不容缓。 本文运用文献检索和分析法、归纳总结法、案例分析法、理论与实证相结合等研究 方法，按照提出问题一，分析问题一解决问题的研究思路，先通过对I习有资产相关概念、 理论的概述，廓清了国有资产流失问题研究的客体范围；然后在简述了我国国有资产流 失的现状、列举了多种表现形式后，深入地剖析了产生国有资产流失的各种主客观、内 外部原因；最后阐述我们应当采取的防范国有资产流失的各种法律对策，旨在引起社会 各界的高度重视，推动立法机关加强和完善国有资产管理立法，积极防范和治理国有资 产流失。 本文的创新之处在于：一是在对“国有资产流失“的性质认定上，笔者认为虽然这 是一。个现象及复杂的过程，但从法律规制角度看，应局限于对非法行为导致的国有资产 流失进行治理和防范，因此应当运用构成要件说或界定标准，将其与其他相近概念如 “国有资产流动”、“国有资产损失”等相区分；二关于国有资产的分类问题，笔者根 据国有资产法律形态的不同仅分为经营性和非经营性国有资产两种；三在进行有关防范 国有资产流失的法律对策研究时，提出建立国有资产保护法律法规体系，并主张在已颁 布的《物权法》基础上，再制定国有资产管理和保护的根本大法 一《国有资产法》。 关键词：国有资产，流失，保护，法律对策 北京科技大学硕士学位论文Research 北京科技大学硕士学位论文 Research on legal issues 011 Stated-owned Assets Drain Abstract During twenty years reform，China always faced to a severe and puzzling reality that is the State—owned Assets Drain．At present．the drain on State-owned Assets is in the severe current situation and becomes more and more terrible．and at last，to shocking Level．However，as all known．the State—owned Assets are the important material basis of our national economy and the modem development，they play a very fundamental role in Chinese political，economic and social life．Therefore，how to prevent the State-owned Assets drain，ensure to retain and increase values of the State-owned Assets，explore the solution to the drain is of great significance． T11is thesis tries to through analyzing the current situation of State-owned Assents Drain， dissecting the all kinds of reasons for the occurrence of State—owned Assets drain，manifesting various countermeasures，include several legal strategies in preventing State—owned Assets Drain，to arousing the general public’s attention，enforces Legislature raising the consciousness of law on the protection of the State—owned Assets，perfecting the legal protection system on the management．So many experts have re
