PAGE PAGE １ 摘 要 WTO争端解决机制被认为是以规则为导向的WTO体系最重要的支柱。新的WTO争端解决机制提高了争端解决的效率和可预见性，通过其争端解决实践强化了WTO各项协议所规定的权利和义务，维护了多边贸易体制的正常运行，促进了多边贸易规则的发展和完善。正是基于WTO争端解决机制对于当今多边贸易体制运行的重要性以及中国加入WT0的新形势，对WTO争端解决机制进行研究具有重要的理论和现实意义。 本文广泛借鉴国内外最新的研究成果，在全面介绍WTO争端解决机制的形成、历史背景、基本情况（包括目标、一般原则、适用范围、机构组成、运行程序等）、特点的基础上，通过对WTO成立以来争端解决实践的统计分析以及对WTO争端解决机制一般的经济学分析，形成对于WTO争端解决机制的总体评价，包括其成就和不足，以及改革建议。最后简要探讨WTO争端解决机制与入世后的中国的相关问题。 关键词：WTO，争端解决机制 ，中国 ABSTRACT Dispute settlement is the central pillar of the rules-based multilateral trading system, and the WTOs unique contribution to the stability of the global economy. Since the foundation of WTO, lots of practices of dispute settlement indicate the WTO dispute settlement system is more effective and predictable than the GATT、dispute settlement system. The WTO dispute settlement is based on clearly-defined rules, with timetables for completing a case, it ensures the right and obligation of the WTO members based on the WTO agreements, and gives maintenance to the running of multilateral trading system, and promotes the development and improvement multilateral trading rules. So it is significant to make a study on WTO dispute settlement, especially for China after the access to WTO. Based on the previous work of many scholars, this thesis devotes to a thorough study on the WTO dispute settlement system, then makes an objective appraisement and gives some proposals. After that, it discusses how to use the WTO dispute settlement system for China after the access to WTO.
