中文摘要环境信息公开是促进公众参与，推进环境民主化进程的重要举 中文摘要 环境信息公开是促进公众参与，推进环境民主化进程的重要举 措，亦是实现可持续发展的重要保证。国际社会对于环境信息公开 的法制建设相当重视，我国政府在立法、执法、管理等方面也开展 了大量的工作，并取得了一定的成绩和经验。本文试图对环境信息 公开法律制度运用规范分析，实证分析，逻辑分析等研究方法进行 初步探讨，并针对我国立法中存在的问题提出若干完善的建议。 第一章集中阐述了环境信息，环境信息公开，环境信息公开法 律制度的基本含义和相互关系，认为环境信息是人们正确认识和解 决环境问题所必需的认知手段和共享资源。环境信息公开应当包含 政府、企业、产品环境信息公开三部分。以法律为形式，以政府、 企业、产品为向度，以向公众公开为对象，以权利为基础，以环境 信息为内容是环境信息公开法律制度的基本特征。 第二章介绍分析了国外及国际环境信息公开的立法现状、内容 与特征，并在比较各国现有法律制度的基础上，归纳总结了国外立 法的主要形式及主要内容。 第三章概述了我国环境信息公开法律制度的基本框架，分析了 其不足：环境权法律地位模糊；政府保障公众环境知情权责任不明 确；单向的公开形式难以有效保障公众环境知情权；公众参与制度 不完善；企业、产品环境信息公开不充分，并针对这些问题提出了 相应的完善措施。 关键词：环境信息 公开 法律制度 研究 ABSTRACTEnvironmental ABSTRACT Environmental information disclosure is a important approach for promoting the citizen participation，advancing the environmental democratization process and it iS also the important insurance ofrealizing sustainable development．The international community pays much attention to the legal construction publicly of environmental information； China govemment，which has launched a large amount of work too，in such aspects as legislation，enforcement and management，has made certain achievement and experience．By normative analysis，real example analysis，logic analysis，the author makes a preliminary study on the taw system of environmental information disclosure，and put some countermeasures and proposal against the limitation of the present legislation． This article contains 3 parts．Chapter 1 concen廿ated on explaining the basic meaning and interrelation of environmental information， environmental information disclosure，and the legal system of environmental information disclosure．The author points out environmental information is the essential cognitive means and shared resource for people’S correct understanding and solving environmental problem，Enviromnental information disclosure should include three parts government’S，enterprise’S，product’S．It is an essential feature ofthe legal system about environmental information disclosure：regar
