Keywords:criminal law;the rights and interests of the young person;oversight;perfectness. 一、引言 未成年人,是一个与成年人相对应的范畴,在我国特指未满18周岁的儿童、青少年由于身体、心智方面的不成熟,尚处于发展过程中,他们一方面处于弱势地位,往往成为犯罪行为侵害的对象,另一方面,又存在反叛传统,蔑视权威的心理倾向(尤以处于青春期的青少年明显),喜欢标新立异,极易受坏人诱惑,染上不良嗜好,甚至走上违法犯罪的道路。近年来，未成年人犯罪越来越高，未成年人犯罪已经成为国际社会普遍关注的严重社会问题，在我国刑事犯罪案件和“犯罪人”数量上占据着较大比例。据统计，2004年全国判决生效未成年犯罪人数比2003年增长19.05％。2005年1月至7月又比2004年同期上升23.96％，并呈现出暴力化、团伙化的趋势。值得注意的是，几乎半数以上的未成年犯在犯罪之前已有不良行为，其中，吸烟、逃学旷课、不良交友和夜不归宿的比例达到80％以上。因此,国家在加大对他们的保护力度,严惩损害其合法权益行为的同时,又要积极预防他
