I I 摘 要 民间借贷在我国有着很久的历史。一方面，民间借贷弥补了金融贷款的不足，拓宽 了中小企业的融资渠道，成为正规金融有益的补充；另一方面，民间借贷游离于国家的 金融监管之外，其自身又具有自发性和隐蔽性，潜在的危险十分巨大，一旦发生资金断 裂，往往引起一系列的不良反应。近几年，随着中国商品经济的发展，民间借贷日渐活 跃，规模也呈上升趋势，在我国部分地区民间借贷出现了无序发展，引起了社会的不稳 定，严重影响了经济社会的稳定和发展。 针对我国民间借贷的现状，本文从三个方面进行论述。首先从法律角度明确民间借 贷的概念，区别合法借贷和非法借贷的不同，分析民间借贷与金融借贷的关系；接着概 括我国民间借贷的现状，分析民间借贷高发的原因；最后针对目前我国民间借贷存在的 问题，提出相应的对策和建议，加快金融改革创新，拓宽民间资本投资渠道，完善民间 借贷立法，赋予民间借贷合法地位，加强综合监督管理，优化金融资源合理配置。 关键词：民间借贷 问题研究 应对之策 III III ABSTRACT The private lending in our country has long history. On the one hand, the private lending make up for the lack of financial loans, broaden the financing channels for SMEs, become the beneficial supplement formal financial. But on the other hand ,the private lending drifts away outside the official financial system, in addition，the private lending has its spontaneity and concealment, its potential risk is very large．Once the capital rupture occurred，the private lending often causes a series of adverse reactions . In recent years ，along with the development of national economy, the private lending presents the active tendency, its scale unceasingly rises, Disorderly development of the private lending has appeared in some sectors, which cause social instability, It seriously influenced the stability and development of the economic society. The discussion about private lending is presented from three aspects. Firstly, an explicit definition of private lending is proposed from a legal point of view, and the analysis of the relation between private lending and financial loans is also given based on the distinction between legal loans and illegal loans. Then according to the existing circumstances，the main causes of the frequent occurrences of private lending . Finally, some strategies and proposals are listed for resolving the existing problems discussed here in order to accelerate financial reform and innovation, enlarge the channel of non-governmental investment, and complete the relevant laws.
