PAGE 2 仲裁庭签发的禁诉令 （作者 北京市环中律师事务所 刘净 刘美邦） 【内容摘要】 随着国际投资贸易的不断发展，跨境商事争议随之暴增。近年来，越来越多的中国企业出现在国际商事仲裁的舞台上。为了更好地保护中国企业的权益，中国涉外律师应当加深对国际商事仲裁新问题的研究，而禁诉令便是其中有意思的问题之一。 禁诉令是法院或者仲裁庭依照一方当事人的申请而签发的命令，用来禁止另一方当事人在其他司法辖区或开庭地开始或者继续诉讼程序。关于国际商事仲裁中的禁诉令，以往的研究主要集中于法院签发的禁诉令对仲裁的影响，包括支持仲裁或抵制仲裁。 相反，本文着重探讨仲裁庭签发的禁诉令，笔者将依次分析仲裁庭签发禁诉令的权力、签发禁诉令的原则、签发禁诉令的形式及后果、禁诉令的送达或执行，并结合仲裁实践，对当事人特别是中国企业如何应对仲裁庭签发禁诉令提出中肯的策略和建议。 【关键词】： 国际商事仲裁 平行诉讼 禁诉令 仲裁庭  Anti-suit Injunction Issued by Arbitral Tribunal [Abstract]: With the increasing development of international investment and trade, cross-broader commercial disputes surge accordingly. Recent years has seen that more and more Chinese enterprises appear in the arena of international arbitration. For better protecting the interests and rights of Chinese enterprises, PRC Lawyers dealing with foreign-related affairs shall deepen the study on the new issues among them anti-suit injunction is an interesting one under the context of international commercial arbitration. Anti-suit injunction is an order issued by a \o Court ordercourt or \o Arbitral tribunalarbitral tribunal upon the application of one party to prevent opposing party from commencing or continuing a proceeding in another jurisdiction or forum. As to anti-suit injunction in international commercial arbitration, the past research mainly focuses on anti-suit injunctions issued by the court imposing influence on the arbitration, including favoring or boycotting arbitration. Instead, this essay particularly deals with anti-suit junctions issued by arbitral tribunal. The author will subsequently analyze arbitral tribunal’s power and the main principles to issue anti-suit injunction, the forms and consequences of the issuance of anti-suit injunction and the service or enforcement of anti-suit injunction and then put forward to pertinent strategies and advises on responding to anti-suit injunction issued by arbitral tribunal for Chinese enterprises based on arbitration practice.
