延边大学硕士学位论文 Abstract As the public right organization, the People’s Court performs the civil law enforcement entitle by the law. Once the public rights go without restrictions, it will lea to rights abuse. An important reason for the current existing phenomenon of “law enforcement chaos” in China was the lacking of procurator ate authority’s effective supervises on the enforcement activities from the People’s Court. An such the lacking was not from the insufficiency of the procurator ate authority, but the shortage in the supervising regulations in Chinese civil law enforcement; an at the same time, the lack in legislate process also plays a vital role: without specific regulations, it deprives the authority of the specific laws to depen on, which contributes to the weakness in the procurator ate authority’s effective supervises. Therefore, research on the theory of the civil law enforcement acquires significant value with such the background. This paper starts from the specific cases of the procurator ate authority’s supervises, an analyzes the problems in the procurator ate authority’s supervises; then the paper illustrates the effective research an achievement from some local authority’s supervise; next, the paper also introduces some relevant legislations from international civil law enforcement; an last, combining the international legislation experience, the paper offers some specific suggestions to perfect the procurator ate authority’s supervise on Chinese civil law enforcement.
