法学硕士论文摘要 法学硕士论文 摘要 在刑事诉讼中，证明标准贯穿始终。刑事诉讼主体在立案、侦查、审查起诉、 定罪量刑等一系列的诉讼活动中，均需运用证明标准。刑事诉讼证明标准蕴涵着 丰富的法学理论与哲学原理，同时又与司法实践紧密相联。因而，刑事诉讼证明 标准的研究既是一个富有学术探讨的理论问题，又是一个关乎司法操作的实践问 题。 我国现行刑事诉讼证明标准的立法表述为“事实清楚，证据确实、充分。从 理论层面而言，这一证明标准的基础是客观真实，目前面临着法律真实的严峻挑 战；从司法实践层面而言，这一证明标准欠缺层次性，操作性不强。这些问题的 存在蕴藏着一场波及刑事诉讼证明标准理论与实践的革命。重建我国刑事诉讼证 明标准具有非常重要的现实意义。重建刑事诉讼证明标准首先必须拓宽理论研究 的视野，其中价值维度与法律经济分析的视角值得关注。特别是刑事诉讼证明标 准的经济分析，这一研究角度对我国而言颇具新颖性，具有启迪性意义。刑事诉 讼证明标准重建的模型是现今刑事诉讼证明标准研究的重点。多维动态证明标准 体系可以作为重建我国刑事诉讼证明标准的参考模型。多维动态刑事诉讼证明标 准体系是一个以证明标准的层次性为基础，区分不同诉讼阶段、证明对象与证明 主体适用场合，逻辑完整严密的证明标准体系。 关键字：刑事诉讼；证明标准；重建；经济分析 论刑事诉讼证明标准Abstract 论刑事诉讼证明标准 Abstract In criminal cases， to prove that runs through all the standards． Criminal proceedings in the main file，inVestigation，the prosecution，conViction and sentencing of a series of lawsuits and other activities，will be required to use those standards． Criminal standards of proof are not rich in legal theory and philosophy principle，but also closely linked with the judicial practice，therefore，criminal standards of proof are a rich academic study of the theory，are a matter of justice and the operation of practical problems． Criminal standards of proof legislation as”the facts are clear，the eVidence is reliable and sumcient．”In a theoretical level，the standards of proof from objectiVe tmth，is the grim reality facing legal challenges in the administration of justice practical level，the level that the lack of standards and maneuVefability is not strong． These problems are anowed to spread a reVolutionary theory and practice，China’s criminal standards that need reconstruction．Criminal standards of proof reconstI]uction are necessarily to broaden the theoretical Vision． Criminal standards of proof on theoretical research must moVe away from the principle of detention of pure philosophy to re-examine the criminal standard settings proVed theoretical basis． Dimensions and the value of the analysis of the legal and economic perspectiVe，renect in terms of our quite novel，a sense of e
