黄 黄 奥：论网络虚拟财产权的物权法保护 中文摘要 随着网络科学技术的飞速发展，与网络虚拟财产相关的法律纠纷络绎不绝。由 于我国目前对针对网络虚拟财产的立法处于空白状态，使得网络虚拟财产权纠纷案 件的审理出现无法律依据可直接适用的尴尬局面。为了解决这一问题，需要对网络 虚拟财产权进行充分的理论研究，并在此基础上有针对性地进行法律完善。网络虚 拟财产是网络用户以一定的金钱或者劳动为对价而获取的，以数据化形式存在于网 络空问，网络用户通过使用和交易对其进行直接支配的财产利益。网络虚拟财产具 有任何财产所具有的价值性和稀缺性的特点。网络虚拟财产具备实在性、特定性以 及确定性三个特征，符合物权客体的法律属性。据此，网络虚拟财产权是以网络虚 拟财产为客体的所有权，属于物权的范畴，具有物权所具备的直接支配性和排他效 力。相较于网络游戏开发研究较为成熟的中国台湾、美国、韩国等地区的立法状况 而言，我国的立法尚处在真空状态。理论和实践证明网络虚拟财产权为物权，对其 保护应该以物权为出发点，将网络虚拟财产权纳入到物权的范畴，并用《物权法》 第三章中的物权的保护方法对其予以保护。针对网络虚拟财产本身所特有的特点， 建立网络虚拟财产的价值评估平台，对其价值予以确定，并建立由政府监管的网络 虚拟财产交易平台以方便其流转，利用交易平台对流转的过程进行公示和监督，是 对网络虚拟财产权进行保护的切实方法。 关键词：物物权物权法网络虚拟财产 扬州入学硕十学位论文 扬州入学硕十学位论文 三 Abstract With the rapid development of network technology,many legal disputes related to the network virtual property emerge in an endless stream．The inquisition of case of the network virtual property is in all awkward situation that no laws are available because the legislation of network virtual property in our country is still blank at present．To solve this problem，full theoretical study of the network virtual property is badly needed and on this basis，the law is perfected with specific purpose．Obtained by certain money or labor consideration，deposited in cyber space in the form of data，Network virtual property is the property interest that is directly dominated by Network users by means of using and trading．As other property,value and scarcity are characteristics of network virtual property．In addition，network virtual property has three other characters：substantiality, specialty and ascertainment，which accords with the legal attribute of property．Hereby, network virtual property is the property taking the network virtual possessions as object， which is under the category of real right and bears the direct domination and exclusion effectiveness．Comparing with the legislation state in Tai Wan，the Unites States and Korea where the development and study of network games are mature，our country’S legislation in this area remains blank．The
