摘要 摘要 删I I I lIlllJiIrrlpllflJJllllflrrllHJJrlll ＼1 924453 摘 要 虚拟财产的出现，无论是对我国的民法理论还是刑法理论，都带来了极大的 冲击。目前我国还没有任何一部法律对虚拟财产的性质和特征予以界定，因此虚 拟财产一直处于法律监管的真空地带。2003年12月18日，我国内地首例盗窃 网络虚拟财产案在北京朝阳区法院开庭审理，其诉讼标的特殊性引发了媒体和学 者的广泛关注，从此，网络虚拟财产作为一种全新的财产形式正式进入了司法的 视野。伴随着网络的普及，虚拟财产的数量急剧增加，虚拟财产的交易数量也逐 步上涨，全国各地关于虚拟财产的案件也是屡见不鲜，公众对虚拟财产进行法律 保护的呼声日益高涨，引发了社会各界尤其是法学界的广泛关注，如何为保护虚 拟财产来提供法律上的依据，已经成为一个亟待解决的问题。 本文共分为四个部分，分述如下： 第一章从对网络游戏的介绍引出网络虚拟财产的概念和特征，本文中的虚拟 财产主要指狭义的网络虚拟财产，它具有虚拟性、现实性、可交易性和期限性的 特点。 第二章阐述了网络游戏中虚拟财产刑法保护的依据，主要从侵犯网络虚拟财 产的社会危害性和网络游戏中虚拟财产刑法保护的必要性角度展开。 第三章讨论了网络游戏中虚拟财产的刑法保护现状，首先介绍了目前我国大 陆地区网络游戏中虚拟财产的立法及司法实践，以及幽外和香港、台湾地区关于 虚拟财产的刑法保护现状，其次对各地立法实践进行比较分析得出可借鉴之处。 第四章主要是确立我国虚拟财产的刑法保护制度，笔者从虚拟财产的法律属 性、价值认定和侵犯虚拟财产的证据取证角度出发提出了相关的立法建议。 关键词：网络游戏，虚拟财产，刑法保护，立法完善 AbstractAbstract Abstract Abstract Emergence of virtual property,whether it is to Chinas civil law theory or to criminal law theory，has brought about tremendous impact．At present 0111country does not have any law which defines the nature and characteristics of virtual prope似 SO“virtual propert)，，’has been in the legal regulation of vacuum．On December 1 8， 2003，the first stealing network virtual property case was heard in Beijing Chaoyang Court，Its particularity of litigation caused media and wide attention of scholars，from then on，the virtual property as a new form of property officially entered the judicial perspective．Accompanied by the popularity of the network，the number of virtual property and property transactions sharp increases，disputes caused by virtual property is explosive growth．Throughout the country on the case of virtual property is also not uncommon，the voice public call for protecting the virtual property is increasingly high．which raises the attention particularly law． This article is divided into four parts，as follows： The first chapter describes the following：It introduces the online game，then explains the concept of virtual property and features．Virtual property in this article means the narrow sense of virtual p
