山东大学硕士学位论文摘要 山东大学硕士学位论文 摘要 我国宪法第一百二十六条规定，人民法院依照法律规定独立行使 审判权，不受行政机关、社会团体和个人的干涉。这从宪法的高度规 定了我国审判权独立的原则。目前，我国审判权独立得到了社会越来 越广泛的承认和支持，但由于体制、制度、管理等诸多方面的原因， 我国法院在依法行使审判权时，往往受到多方干扰，无法独立审判。 如何在现行体制下实现中国特色的审判权独立，己经成为重大而迫切 的理论命题。鉴于此，本文作者结合工作实际，从审判权独立的历史 分析入手，结合对宪法第一百二十六条的深入理解和剖析，着重从两 个方面深刻分析了影响我国审判权独立的各种因素，并有针对性的提 出了完善我国审判权独立的建议。文章认为，要实现我国审判权独立 不能满足于对现有制度的修修补补，而应从理顺与党委人大以及上下 级法院的关系、完善法院内部机制、保障法官的身份和地位等方面， 增强法院对各种外力的抗干扰能力。唯有如此，中国特色审判权独立 才能真正实现。 关键词：审判权独立 法院 法官 宪法第1 26条 嘶旆 】011．t|·工Z I 山东大学硕士学位论文Summary 山东大学硕士学位论文 Summary Our country constitutional law imprimis 1 26 regula：tion rules settle，the court of the people subject to the law stipulates exercise judicial power independently and is free from administrative board,social society and personal interference．This is from the constitutional law of high stipulated an our sag independent axiom．Currently，the OUr country sac independently obtained society more and more extensive ratification and sustenance，but various because of s缸uCtur岛system，and handing etc．various of CaSUS， OUr county court when the at law exercises sac，be in many ways usually subjected to molestation,can not independent adjudication．How realize the sac independence of Chinese special feature under the current structure，F through become an important but urgent school to set question．Owing to this，the text author joins a task practice，the independent history analysis commences from the sac and joins 1 26 thorough comprehensions and analysis versus the constitutional law imprimis and emphasize from two profoundly analysed impact our country the sac is various independent factor,also aim at sex of prefered integrity Our country the sac is independent to suggest．The article thinks that realize Our country the sac independently Can not satisfied with verslk‘； existing system of fix a repair to repair，but should from reason agreeable and party Wei the person is big and relation,perfect inner part mechanism in the court of top court below,guarantee the ordinary’S standing
