摘要摘 摘要 摘 要 商业贿赂犯罪严重地侵害了市场经济公平的交易秩序，其具有严重的社会 危害性。随着国际和国内一些著名大型企业商业贿赂案的陆续曝光，更加暴露 了商业贿赂行为危险性的真实面目。在我国的银行业、政府采购行业、房地产 及建筑工程行业、医疗药品行业、矿产权出让、教育行业等有关经济利益巨大 的领域发案的概率高、灾害严重。在中国社会的转型时期商业贿赂的盛行是一 种自然的现象，但却很大地威胁了我国经济与社会的发展。 商业贿赂是贿赂的一种形式，是商品经济发展的负面产物，给各国的经济 发展带来了直接的、或间接的影响。我国商业贿赂犯罪呈现严重性和普遍性的 特征，造成这一问题的根本原因则是我国商业贿赂犯罪的有关刑事立法不够完 善。因此，完善我国的商业贿赂立法已成为当务之急。我国在反商业贿赂犯罪 立法相对比较落后，和联合国的相关法律文件、世界发达国家的法律规定相比， 还存在着一定程度的差距。通过对比，发现自己的缺陷和不足，学习和借鉴世 界发达国家甚至联合国的相关法律文件的规定和立法经验，从而完善我国的商 业贿赂犯罪立法。 本文纵观中外商业贿赂犯罪的立法规定，指出我国商业贿赂犯罪立法在主 体、构成要件、刑罚制度等方面的有关缺陷，主张应当从主体、构成要件、刑 罚制度等方面对我国商业贿赂犯罪的立法加以完善，从而为有效的提供预防和 惩治商业贿赂犯罪的提供法律依据。 关键词：商业贿赂犯罪主体构成要件刑罚 AbstractCommercial Abstract Commercial bribery crime seriously violated market economy fair trading order, it has serious social harmfulness．Along wim international and domestic some famous large enterprise commercial bribery in succ燃Mon,the more exposed the exposure of commercial bribery risk true colors．In Chinas banking,govcmment procurernent industry,real estate and construction industries，medical pharmaceutical industry,mineral rights assignment,education industry and other relevant economic interests in the fields of probability probably huge high,disasters seriously．Social transformation period in China,the prevalence of commercial bribery is a natural phenomenon,but greatly threat for China’S economic and social development． Commercial bribery is a form of bribery,is the development of commodity economy,the negative outcome for countries， economic development brought directly,or indirect impact．Our commercial bribery crime presents the characteristics of seriousness and universality,causing the root cause of the problern is Chinas commercial bribery crime relevant criminal legislation imperfect． Therefore，perfect our commercial bribery legislation has become a top priority．Our country against commercial bribery legislation in,and the United Nations Was relatively backward relevant legal documents，developed countries of the world than prescribed by law,there are som
