摘 摘 要 居住权起源于罗马法，后被大陆法系一些国家和地区的民法所承袭。在我 国，近年来理论界对于是否有必要确立居住权制度颇有争议。虽然2002年提交 的《民法典》(草案)首次将居住权界定为一种用益物权，但相关的规定尚不完 备，远不能适应现实的需要。 准确把握居住权的内涵，是构建居住权制度的基础。本文在第一章详细论 述了居住权的基本理论，首先从居住权的历史沿革入手，介绍了始于罗马法的居 住权产生及演变的过程；阐述了居住权在物权法体系中的地位。然后，归纳总结 出居住权的概念、性质和特征。为了进一步了解居住权制度}由发展现状，本文第 二章对大陆法系主要国家和地区有关居住权的法律规定进行了介绍和简评。在第 三章中，针对我国住房制度和社会弱势人群的住房困境，以及立法和司法领域面 l临的诸多问题，分析在我国建立居住权制度的必要性。第四章则从居住权概念的 界定、主体、内容、取得方式、消灭情形等方面，通过对《民法典》(草案)关 于居住权规定的检讨，对我国应建立怎样的居住权制度，以及居住权与其他权利 的冲突的解决提出自己的见解。 关键词：居住权；人役权；用益权；物权法 AbstractThe Abstract The dwelling fight originated from the Rome Law and was adopted by countries of continental law system in their civil codes． In our country,there has been a controversy in the academic circles on the necessity of establishing the system of dwelling fight．The dwelling fight was first defined as a usufi-uctuary right in the Civil Codes(protoc01)in 2002，however the relating provisions are still too incomplete to meet the needs． An accurate grasp of the meaning of the dwelling right is the base of establishing the system of dwelling right．The first chapter mainly deals with the basic theories of the dwelling right．The author introduces the emergence and development of the dwelling right and demonstrates the position of the dwelling right in the system of jus rerem．Afterwards，the definition，characters and essence of the dwelling right are concluded in this chapter．In order to show the present situation of the development of the dwelling fight，all introduction of provisions of the main countries of continental law system is given in the second chapter．Then，the third chapter focuses on demonstrating the necessity of establishing the system of dwelling ri曲t in China by representing the problems in the field of legislation and judicature as well as the dwelling system and the difficult position of the group in poverty in China．In the last chapter, the the author discusses the dwelling right on its definition，subject， content，the way of acquiring and the extinctive condition，and
